Résumé Omnilex

In a patent dispute between Fabrique des montres Vulcain et Studio SA and Enicar SA, the Federal Court stated that the state of the art for novelty may include earlier realizations or publications ignored or forgotten by technicians under Article 4 LBI 1907. By contrast, when assessing technical progress and inventive step, only the effective knowledge of skilled persons is relevant. A prior invention counts only if it genuinely influenced the development of the art; a disclosure that was never disseminated or had fallen into oblivion cannot be used to deny inventiveness.

Regeste Omnilex

Art. 4 LBI 1907; novelty and inventive step; forgotten prior art. For novelty, the statutory notion of the state of the art may extend, by legal fiction, to earlier realizations or publications unknown or wholly forgotten by skilled persons. For the assessment of technical progress and inventive step, however, the relevant state of the art is determined by the effective knowledge of the art; only those earlier inventions that actually influenced technical development are to be taken into account. A publication not disclosed or fallen into oblivion is therefore irrelevant to inventive step (consid. 1).

7 rem. 6, p. 342; TROLLER, Immaterialgüterrecht, I, p. 202 et suiv.).

Question juridique clé

Whether an earlier realization or publication unknown or forgotten by technicians counts as prior art for novelty and inventive step under the 1907 Patent Act.

Solution extraite

For novelty, such an antecedent may count under Article 4 LBI 1907 as a legal fiction; for inventive step, only the effective knowledge of skilled persons matters.

Motifs extraits

The court distinguished novelty from inventive step. In novelty, the statute permits a fictitious state of the art, including forgotten prior disclosures. In assessing technical progress and inventive level, however, only inventions that actually influenced technical development are relevant; a publication not disseminated or long forgotten cannot be considered.
