In a criminal cassation matter, the Federal Court stated that legal instructions given in a remand decision are themselves final and bind both the cantonal authority and the Federal Court on any subsequent appeal. The court may then review only whether the new cantonal decision remains within the scope of those instructions. It also refused any exception where, after remand but before finality of the cantonal decision, the Federal Court had decided the same legal question differently in another case, because that would amount to an inadmissible revisio in iure.

Nach Art. 277 ter Abs. 2 BStP muss die kantonale Behörde, an die der Kassationshof auf Nichtigkeitsbeschwerde hin die Sache zu neuer Entscheidung zurückweist, dem neuen Urteil die rechtliche Begründung der Kassation zugrundelegen. Die Entscheidung des Bundesgerichts wird gemäss Art. 38 OG mit der Ausfällung rechtskräftig, und an der Rechtskraft nehmen deshalb auch die Weisungen teil, die der kantonalen Instanz im Entscheid erteilt werden. Daraus folgt, dass die Weisungen nicht nur die kantonale Behörde, sondern auch das Bundesgericht selber binden. Der Kassationshof kann daher, wenn gegen das neue Urteil der kantonalen Behörde Nichtigkeitsbeschwerde geführt wird, auf seine Weisungen nicht mehr zurückkommen; insoweit hat er das neue Urteil nur daraufhin zu überprüfen, ob es im Rahmen der erteilten Weisungen bleibt.

Eine Ausnahme ist auch dann nicht zu machen, wenn das Bundesgericht nach Ausfällung eines Rückweisungsentscheides, aber bevor das neue Urteil der kantonalen Behörde rechtskräftig geworden ist, in einem anderen Falle die gleiche Rechtsfrage anders enscheidet. Könnte der Kassationshof, wenn er durch Nichtigkeitsbeschwerde gegen das neue Urteil der kantonalen Behörde ein zweites Mal mit der Sache befasst wird, eine Änderung der Rechtsprechung berücksichtigen, so würde dies auf eine revisio in iure hinauslaufen, was selbst bei denjenigen Bundesgerichtsentscheidungen, die der Revision unterliegen, nicht zulässig ist (Art. 136 und 137 OG; Art. 229 und 230 BStP). Umso weniger kann in Frage kommen, dass Entscheidungen des Kassationshofes, die im Strafpunkt der Revision überhaupt nicht zugänglich sind (BGE 80 IV 143), einer neuen rechtlichen Überprüfung unterzogen werden.
