Résumé Omnilex

The Federal Court held that health-care costs may form part of the debtor’s subsistence minimum in wage garnishment, and a temporary increase is possible for imminent medical expenses. But an invoice for dental treatment already completed before enforcement is merely an existing debt and cannot be deducted under Art. 93 SchKG. The lower court must therefore exclude the CHF 220 item and recalculate the minimum subsistence amount.

Regeste Omnilex

Art. 93 SchKG; subsistence minimum in wage garnishment and health-care expenses; only expenses actually arising during the garnishment period may be taken into account. The debtor’s necessary maintenance includes health-care costs, and a flat allowance or temporary increase may be justified for imminent medical outlays. By contrast, a claim for treatment already performed before the enforcement measure constitutes a pre-existing debt and cannot reduce the attachable income. In recalculating the minimum subsistence amount, the authority must therefore disregard such prior liabilities (consid. 1).

Question juridique clé

Whether an already incurred dental invoice may be added to the debtor’s necessary subsistence minimum under wage garnishment rules.

Solution extraite

No. Only expenses for current or imminently expected health-care needs may be taken into account; an existing debt for treatment already performed before enforcement cannot be deducted from the attachable income.

Motifs extraits

The necessary minimum includes health-care expenses, and a flat allowance or a temporary increase may be justified for imminent medical outlays. Here, however, the dentist invoice concerned treatment already completed before enforcement, so it was a pre-existing debt. Under the true meaning of Art. 93 SchKG, such a debt cannot reduce the subsistence minimum; only needs arising during the wage garnishment period are relevant.
