In cassation, Morger argued that his willingness to renounce driving a motor vehicle should support a conditional sentence. The court held that such a promise does not remove doubts about future good conduct, especially when made from fear of punishment rather than reform. It further held that a judicial instruction under Art. 41 no. 2 StGB may only support a defendant who already satisfies the requirements for conditional release and cannot be used to obtain conditional punishment for an offender who does not merit it.

Where the promise is made primarily out of fear of punishment, it does not establish the requisite prospect of reform. The judicial instruction of Art. 41 Ziff. 2 StGB is only an auxiliary measure for persons already meeting the conditions of Art. 41 Ziff. 1 StGB; it cannot be employed to confer conditional suspension on an offender who lacks the subjective prerequisites. Considerations of equal treatment also preclude allowing a financially advantageous self-restraint to replace the legal prognosis.

Was der Beschwerdeführer vorbringt, vermag die Zweifel an seinem künftigen Wohlverhalten nicht zu beseitigen. Insbesondere seine Erklärung, er sei bereit, auf das Führen eines Motorfahrzeuges zu verzichten, ändert an der Beurteilung der Besserungsaussichten nichts. Das Versprechen enthält nicht schon die Gewährleistung, dass es eingehalten wird, und ebensowenig bildet es einen Ersatz. für die nach Art. 41 Ziff. 1 Abs. 2 StGB auf Vorleben und Charakter gestützte ungünstige Voraussage, zumal es der Beschwerdeführer nach der verbindlichen Feststellung der Vorinstanz aus Furcht vor dem Strafvollzug abgegeben hat, also nicht vorwiegend im Bestreben, sich zu bessern. Auch eine entsprechende richterliche Weisung, die das Versprechen des Beschwerdeführers wirkungsvoller und möglicherweise erfolgreicher gestalten würde, fällt ausser Betracht. Art. 41 Ziff. 2 StGB sieht die richterliche Weisung zur Unterstützung desjenigen vor, der die Bedingungen der Ziff. 1 bereits erfüllt. Sie kann daher nicht einem Täter zum bedingten Strafvollzug verhelfen, der ihn subjektiv nicht verdient. Eine andere Betrachtungsweise könnte zur Unbilligkeit führen, dass der finanziell besser gestellte Täter, der sich den Verzicht leisten kann, gegenüber demjenigen bevorzugt würde, der auf das persönliche Führen eines Motorfahrzeuges angewiesen bleibt.
