Résumé

The court held that Art. 59 BV protects only against intercantonal forum in the traditional sense and cannot be relied upon by a defendant merely because he lives in another district of the same canton. However, because the claimant had sued all sons/heirs of Fidel Depuoz jointly and sought an enforceable judgment, the action had to be directed against all of them. The success of the other appellants therefore required the contested orders to be annulled also as against Simon Depuoz.

Art. 59 BV; intercantonal scope of venue protection and joinder of heirs; the constitutional venue guarantee may be invoked only in an intercantonal setting and not against an intra-cantonal district forum. Where a claim is directed jointly against all heirs of a deceased person and an enforceable judgment is sought, the action must be brought against all joint defendants; if the complaint of some defendants is upheld, the annulment must extend to all co-defendants owing to the unitary character of the dispute and the need for consistent enforceability.

Erwägung 2

  1. Art. 59 BV hat nur interkantonale Bedeutung. Er kann demnach von dem im Kanton Graubünden wohnhaften Rekurrenten Simon Depuoz nicht angerufen werden, obwohl er seinen Wohnsitz nicht im Bezirk Heinzenberg, sondern in einem andern Bezirk des Kantons hat. Doch richtet sich die Klage nicht gegen diesen Rekurrenten allein, sondern gegen alle Söhne (Erben) des Fidel Depuoz als Streitgenossen und muss gegen alle gerichtet werden, wenn der Kläger ein der Vollstreckung fähiges Urteil erwirken will. Die Gutheissung der Beschwerde der andern Rekurrenten muss daher die Aufhebung der angefochtenen Verfügungen auch gegenüber Simon Depuoz nach sich ziehen.
