In the composition proceeding of Pomerantz, the debtor sought reduction of a creditor’s claimed uncovered amount because a pledged promissory note allegedly belonged to a third party. The Federal Court held that the copy of the second notice of the creditors’ meeting and inspection period was admissible and that the lower appellate court was wrong to treat the complaint as late. However, it confirmed the dismissal because supervisory authorities lack competence to decide how much of a pledged claim counts as uncovered in composition proceedings. That question belongs to the composition authority in the confirmation procedure.
Art. 304 and 305 SchKG; composition proceedings: determination of the amount in which secured claims participate as uncovered. The trustee does not establish an attackable collocation plan subject to supervisory complaint. In composition proceedings, the trustee merely submits a report to the composition authority; the decision whether the composition is accepted, and as a preliminary question the amount to be counted for pledged claims, lies exclusively with that authority. No concurrent competence of the supervisory authorities exists. By contrast, for conditional, time-barred, or disputed claims, Art. 305(3) SchKG expressly assigns the counting decision to the composition authority. A complaint against the trustee’s calculation is therefore inadmissible on the merits and must be raised in the confirmation proceedings (consid. 2).
