The cantonal court dissolved the marriage but left custody of the child and maintenance unresolved for a later ruling after receiving the tutelary authority’s opinion. The wife nevertheless brought a reform appeal to the Federal Court, repeating her divorce claims and requesting custody and alimony. The Federal Court held that reform appeals are admissible only against final judgments on the merits. Because the cantonal decision expressly reserved the consequences of divorce, it was only a partial judgment. The appeal was therefore premature and the Federal Court refused to enter into the matter.
Art. 58 OJF; reform appeal against a cantonal judgment that decides only part of the claims is inadmissible. A judgment is not final on the merits where the cantonal court expressly reserves remaining conclusions, in particular the consequences of divorce, for a later decision. Such a partial judgment cannot be attacked by reform appeal before the supplementary decision is rendered; the remedy is premature and results in non-entry (consid. 1).
