Frau Schröder complained that the Betreibungsamt Zürich I again refused to attach certain incoming money orders under an arrest order and asked that the office be provisionally compelled to execute the arrest. The lower and cantonal supervisory authorities refused. On appeal, the Federal Court held that the SchKG authorizes supervisory authorities to suspend execution of a challenged act under Art. 36, but does not empower them to order provisional execution of an enforcement measure that the office has refused to carry out. The appeal was therefore dismissed.
Art. 36 SchKG; Art. 21 Abs. 2 SchKG; provisional execution pending complaint against refusal to perform enforcement act: the supervisory authority is empowered to grant suspensive effect, but not to order, even provisionally, the execution of a measure refused by the office. The statutory silence is understood as a conscious exclusion of such competence; otherwise the summary complaint procedure would require a preliminary and a final decision on the same request. Any damage caused by delay is to be pursued, where applicable, under Art. 5 ff. SchKG (consid. 1).
