Germany requested extradition of Wilhelm Schmidt and delivery of seized assets in Zurich. Schmidt did not oppose his extradition, but Litholin, claiming a Swiss attachment on the assets, objected to the surrender of the property. The Federal Court held that Article 27 AuslG makes the surrender of seized items accessory to the extradition of the person and that it may decide on such surrender only when it is already seized of the person's extradition because that person has filed an objection under Articles 23 and 24 AuslG. As Schmidt raised no such objection, the Federal Court lacked jurisdiction and did not enter into Litholin's objection.

The surrender of papers, valuables and other seized objects under Art. 27 AuslG is not an independent matter but follows the competence for deciding the personal extradition request. The Federal Court may rule on such a surrender only where it is already called upon to decide the extradition of the person pursuant to an objection by that person under Arts. 23 and 24 AuslG. If the requested person consents to extradition and no qualifying objection is raised, jurisdiction lies with the Federal Council under Art. 22 AuslG; a third party has no separate access to the Federal Court for challenging the accessory surrender order.
Auslieferungsdelikte im gesetzlich oder vertragsgemäß erforderlichen Zusammenhange stehend herauszugeben seien, derjenigen Behörde zukommt, die nach Maßgabe der erörterten Kompetenzausscheidung über die Auslieferung der Person des Verfolgten zu befinden hat. Folglich kann das Bundesgericht nur dann in die Lage kommen, sich überhaupt mit dieser Frage zu befassen, wenn der Verfolgte selbst gegen seine Auslieferung eine Einsprache im Sinne von rt. 23 AuslG erhoben hat. Es hat denn auch bisher über Sach auslieferungsbegehren stets unter solchen Umständen geurteilt (vergl. aus der neueren Zeit die Urteile i. S. Tonelli: AS 31 1 Nr. 81 Erw. 1 ff. S. 501 ff.; i. S. Belenzow: 32 I Nr. 77 eingangs und Erw. 1 S. 546 und 548; i. S. Pietsch: AS 34 I Nr. 56 Erw. 5 S. 368 ff). Im hier gegebenen Falle aber trifft diese Voraussetzung nicht zu. Demnach fehlt dem Bundesgericht die Kompetenz zur Beurteilung der vorliegenden Dritteinsprache; - erkannt: Auf die Einsprache der Gesellschaft Litholin wird nicht ein getreten.
