Spahr, a creditor in the bankruptcy of Jakob Städeli, asked the Federal Court to force compliance with an earlier Federal Court judgment and to accelerate the liquidation. The Court held that complaints about non-execution of a federal judgment by a canton fall under Art. 45 OG and must be brought to the Federal Council, not the Federal Court. It further held that the request to speed up the bankruptcy proceedings was, in substance, a complaint against the bankruptcy office and should first have been submitted to the cantonal supervisory authority; no actionable delay by that authority under Art. 19(2) SchKG was shown. The appeal was therefore not entered into.

  1. Entscheid vom 16. November 1911 in Sachen Spahr. Art. 45 Abs. 2 0G: Inkompetenz des Bundesgerichtes zur Behand lung von Beschwerden wegen Nichtvollziehung seiner Urteile. A. Durch Urteil des Bundesgerichts vom 8. Dezember 1910 wurde auf eine Beschwerde des Rekurrenten Spahr, Buchdruckers in Bern als Gläubigers im Konkurse des Jakob Städeli das Kon kursamt Bern Stadt angewiesen, Verteilungsliste und Schlußrech nung im erwähnten Konkurse dahin abzuändern, daß der dem Joseph Purro ausbezahlte Betrag von 500 Fr. nicht als Aus gabe eingestellt, sondern als Aktivum behandelt werde, das bei der Berechnung des zur Verteilung gelangenden Massagutes zu berück sichtigen sei. Am 22. Februar 1911 beschwerte sich der Rekurrent bei der kantonalen Aufsichtsbehörde mit dem Begehren, sie solle dafür sorgen, daß die Verteilungsliste im Sinne des bundesgericht lichen Entscheides abgeändert werde. Durch Entscheid vom 26. Mai 1911 wies die kantonale Aufsichtsbehörde das Konkursamt Bern Stadt an, beförderlich die Abänderung der Verteilungsliste vorzu nehmen. Am 2. Juni 1911 teilte sie sodann der kantonalen Justizdirektion mit, daß voraussichtlich der Kanton zur Leistung des fehlenden Betrages von 500 Fr. werde herangezogen werden und sie ihr daher die Anordnung der nötigen Maßnahmen überlassen müsse. B. Mit Eingabe vom 1. November 1911 stellt nun der Ges.-Ausg. 29 IS. 218 f. Erw. 2. Rekurrent beim Bundesgericht das Gesuch, es möchte dem bun desgerichtlichen Entscheide vom 8. Dezember 1910 sofort Nachach tung verschafft werden und es seien die erforderlichen Verfügungen zu treffen, damit im Konkurse des I. Städeli die Liquidation rascher vor sich gehe . Er macht geltend, daß trotz wiederholter Reklamationen das Konkursamt Bern Stadt nicht dazu zu bewegen sei, die vorgeschriebene Abänderung von Verteilungsliste und Schluß rechnung vorzunehmen. Die Schuldbetreibungs und Konkurskammer zieht in Erwägung:
  2. Nach Art. 45 OG sind Beschwerden wegen Nichtvoll ziehung eines bundesgerichtlichen Urteils durch einen Kanton an den Bundesrat zu richten. Demgemäß ist das Bundesgericht zur Behandlung des Begehrens, es sei für die Vollziehung des bun desgerichtlichen Urteils vom 8. Dezember 1910 zu sorgen, unzu ständig. Wenn der Rekurrent also die kantonale Aufsichtsbehörde dazu verhalten will, durch Anwendung der ihr nach Art. 14 SchKG zustehenden Disziplinarmittel das Konkursamt Bern Stadt zum Vollzug des bundesgerichtlichen Entscheides zu zwingen, so kann er ein solches Begehren nur beim Bundesrat anbringen.

Auch auf das Begehren, es sei dafür zu sorgen, daß die Konkursliquidation rascher vor sich gehe, kann das Bundesgericht nicht eintreten, weil dieses Begehren sich als Beschwerde über das Konkursamt Bern Stadt darstellt und daher zunächst an die kan tonale Aufsichtsbehörde hätte gerichtet werden sollen. Es handelt sich nach dem Rekurse nicht um eine durch die kantonale Aufsichts behörde begangene Rechtsverzögerung, die nach Art. 19 Abs. 2 SchKG zur Beschwerdeführung beim Bundesgerichte berechtigen würde. Demnach hat die Schuldbetreibungs und Konkurskammer erkannt: Auf den Rekurs wird nicht eingetreten.
