  1. Urteil vom 20. Mai 1899 in Sachen Vieser gegen Müller Trüeb. Form der Berufung beim schriftlichen Verfahren. Art. 67 Abs. 4 Organ.-Ges. Die Rechtsschrift ist innert der Berufungsfrist einzulegen. A. Durch Urteil vom 4. April 1899 hat das Handelsgericht des Kantons Aargau erkannt: Der Kläger ist mit seiner Klage abgewiesen. B. Gegen dieses Urteil ergriff der Kläger am 12./13. Mai 1899 die Berufung an das Bundesgericht mit dem Bemerken, daß er unter Verweisung auf die Akten Zuspruch seiner Klage vom Dezember v. J. verlange. Er fügte bei: Zugleich führe ich hier an, daß sich meine Berufung auf den Umstand stützt, daß im handelsgerichtlichen Urteil verschiedene in den Akten enthal tene Thatsachen nur oberflächlich, zum Teil aber gar nicht ge würdigt worden sind und bin ich bereit, eine nähere Begründung zu dieser Berufung nachträglich auf Verlangen beizubringen.... Das Bundesgericht zieht in Erwägung. Da der Streitwert den Betrag von 4000 Fr. nicht erreicht, so greift gemäß Art. 67 Abs. 4 O. G. das schriftliche Berufungs verfahren Platz. In diesem gehört aber, wie das Bundesgericht stets festgehalten hat, zur Rechtswirksamkeit der Berufungserklä rung, daß derselben binnen der Berufungsfrist eine die Berufung begründende Rechtsschrift beigelegt werde. Dieses Er fordernis ist im vorliegenden Falle nicht erfüllt. Denn die Bemerkung in der Berufungserklärung, das angefochtene Urteil würdige verschiedene, in keiner Weise näher bezeichnete Thatsachen, nur oberflächlich und zum Teil gar nicht, enthält offenbar gar keine sachliche Begründung der Berufung und vermag daher die vom Gesetze geforderte begründende Rechtsschrift, auf welche hin das schriftliche Berufungsverfahren (durch Mitteilung derselben an die Gegenpartei zur Vernehmlassung) einzuleiten ist, nicht zu ersetzen. Die vom Berufungskläger in Aussicht genommene nach trägliche Einreichung einer begründenden Rechtsschrift ist, da die Einreichung der Rechtsschrift zu den Formalien der Berufung

gehört und daher binnen der Berufungsfrist geschehen muß, un statthaft. Demnach hat das Bundesgericht erkannt: Auf die Berufung des Klägers wird nicht eingetreten.
