Gabriel Rampini sought definitive release in Roveredo based on a Paris judgment awarding him damages and costs against Peter Rampini after a bodily-injury case. The Kreisamt refused on the ground that the underlying decision came from a criminal court and was therefore outside the Swiss-French treaty on enforcement of civil judgments. The Federal Court held that a civil award in adhesion proceedings is still a civil judgment within Article 15, that the treaty's second part does not depend on the parties' nationality, and that the French courts were competent under Article 17 No. 1. The complaint was therefore upheld and the refusal set aside.
Art. 15 and 17 No. 1 of the Swiss-French treaty of 15 June 1869; enforceability of a civil award rendered in criminal adhesion proceedings. The concept of a civil judgment is determined by the nature of the claim adjudicated, not by the ordinary classification of the rendering court. A final decision on a private-law claim remains a civil judgment even when issued by a criminal court in adhesion proceedings and is therefore capable of enforcement under the treaty. The treaty's second part applies irrespective of the parties' nationality. For Article 17 No. 1, it suffices that the foreign court had jurisdiction over the claim, including under forum delicti commissi and the defendant's domicile; the enforcement duty is not confined to the jurisdictional grounds enumerated in the treaty's first part (consid. 1-3).
Vollstreckung im schweizerisch französischen Gerichtsstandsvertrag nicht zugesichert, und es brauche auch der die Civilfrage beschla gende Teil eines solchen, in dem einen Vertragsstaate ausgefällten Urteils im andern nicht exequiert zu werden. Nicht einmal interkan tonal sei die Exekution eines Adhäsionsurteils anerkannt, da rt. 61 der Bundesverfassung diese nicht umfasse. Um so weniger könne die Vollstreckbarkeit im interkantonalen Verkehr anerkannt werden. Zudem seien vorliegend die im Staatsvertrag hiefür vor gesehenen Bedingungen nicht erfüllt. Die Parteien seien beide schweizerischer Nationalität; daher treffe der Vertrag nicht zu. Das Urteil gehe aber auch nicht von einer kømpetenten Behörde aus, da im Vertrag das forum delicti commissi nicht vorge sehen In ähnlichem Sinne ließ sich das Kreisamt Roveredo auf den Rekurs vernehmen. Das Bundesgericht zieht in Erwägung:

Ebenfalls erst im Rekursstadium wurde die Frage der Kom petenz des urteilenden Richters aufgeworfen, die allerdings nach Art. 17 Ziff. 1 des Gerichtsstandsvertrages für die Vollstreckbar keit des Urteils von Bedeutung ist. Diesbezüglich erweist sich zunächst der Einwand, daß der Vertrag das forum delicti com missi nicht vorsehe, deshalb als unstichhaltig, weil sich die im zweiten Abschnitt des Vertrages aufgestellte Pflicht zur Urteils vollstreckung nicht auf die Fälle beschränkt, für die im ersten Abschnitt desselben bestimmte Gerichtsstandsnormen aufgestellt worden sind (s.
