Joh. Buff challenged a St. Gallen cassation judgment that had annulled his acquittal for bannbruch and sent the case back to a differently constituted cantonal court. The Federal Court held that the cassation decision did not itself determine the criminal case, but only set aside the acquittal. Because no final cantonal merits decision existed yet, the complaint was premature and therefore not admissible. The court emphasized that the retrial court remained free to decide the case independently, including on the constitutional question relied on by the cassation court.
Art. 59 OG; admissibility of a federal complaint against a cantonal cassation decision: a decision that merely annuls a lower-court judgment and remits the case for a new merits determination does not itself constitute a final criminal determination amenable to immediate federal complaint. The effect of cassation is confined to setting aside the attacked judgment; the substantive adjudication remains with the remitting court, which is not bound by the cassation court's legal reasoning. Where the accused is only returned to the procedural state of indictment, the federal remedy is premature and must be dismissed as inadmissible (consid. 2-3).
Rekurrent habe bei Konstituirung des in Art. 189 der st. gallischen St. P. O. vorgesehenen außerordentlichen Kantons gerichtes mitgewirkt, ohne Einsprache oder einen Vorbehalt ein zulegen, und damit faktisch anerkannt, daß das für den Straf fall Buff besonders konstituirte Gericht zunächst spruchberechtigt sei. Derselbe müsse daher dieses Gericht sprechen lassen, ehe er berechtigt sei, den Rekurs an das Bundesgericht zu ergreifen. 2. Nach Art. 59 des Bundesgesetzes über die Organisation der Bundesrechtspflege sei das Recht der Beschwerde an die Voraussetzung geknüpft, daß die Beschwerde gegen Verfügungen kantonaler Behörden gerichtet sei. Vom Standpunkte des Strafrechtes aus könnte unter einer solchen Verfügung nichts anderes verstanden werden, als ein wirkliches Urtheil über Schuld oder Nichtschuld des Angeklagten. Der angefochtene sich aber nicht zu einem Straf Kassationsentscheid qualifizire sondern hebe einfach das kantons urtheil gegen den Rekurrenten, weise den Fall zu neuer Beur gerichtliche Urtheil auf und
theilung zurück, so daß die Rechtssituation gegenwärtig gerade so sei, wie wenn in Sachen kein Urtheil des Kantonsgerichtes existiren würde. Das Bundesgericht zieht in Erwägung:
