Huber, under guardianship after her husband's bankruptcy, challenged a land exchange approved by the municipal guardianship authority and upheld by the cantonal government. She argued that the exchange of Bachmatt for Stadel violated the constitutional property guarantee and lacked required publication. The Federal Court held that a guardian acts as the ward's legal representative, so a transaction made within statutory authority and approved by the guardianship authority is attributable to the ward, not a third-party taking. It further held that the cantonal guardianship statute required prior notice only for sales, not exchanges. The complaint was dismissed.
Art. 10 K.-V.; guardianship disposal of a ward's real property by exchange; constitutional property guarantee not implicated where guardian and guardianship authority act within statutory powers. A disposition made by the guardian with the required approval is legally treated as an act of the ward itself, not as an interference by third parties or the administration. Alleged non-observance of statutory formalities can at most raise a question of statutory legality, not of constitutional violation; moreover, where the guardianship statute distinguishes between sale and exchange, the publication requirement applicable to sales does not extend to exchanges of ward land (consid. 1-2).

Nun ist der streitige Tausch vertrag durch den Vormund der Rekurrentin mit Genehmigung der Vormundschaftsbehörde, des Gemeinderathes, innerhalb der Schranken der gesetzlichen Vollmacht der vormundschaftlichen Or gane abgeschlossen worden; es ist daher klar, daß hier von einer Verletzung der verfassungsmäßigen Eigenthumsgarantie nicht die Rede sein kann. Wenn die Rekurrentin behauptet hat, es seien bei Abschluß des Tauschvertrages die gesetzlichen Formalitäten nicht beobachtet worden, so ist darauf zu erwidern, einerseits daß es sich in dieser Richtung nur um eine Gesetzes nicht aber um eine Verfassungsverletzung handeln könnte, andrerseits daß das obwaldensche Vormundschaftsgesetz (Art. 32) die vorgängige Be kanntmachung nur für den Verkauf, nicht aber für die von ihm gleichfalls (Art. 31) ausdrücklich zugelassene Vertauschung von Mündelgrundstücken fordert. Der Rekurs muß daher als unbe gründet abgewiesen werden, obschon zugegeben werden mag, daß es vielleicht nicht zweckmäßig ist, wenn die Gesetze die Ver tauschung von Mündelgrundstücken anders als unter ganz spe ziellen Kauteln gestatten. Demnach hat das Bundesgericht erkannt: Die Beschwerde wird als unbegründet abgewiesen.
