Eduard Wetzel challenged an Aargau conviction for malicious neglect of support duties, arguing that prosecution was unlawful because no extradition request had been made to the authorities of his domicile canton Zurich. The Federal Court held that the federal extradition procedure applies only to offenses for which extradition is mandatory under the Federal Act of 24 July 1852, not to other delicts. Since the charged offense was not extraditable as of right, the prosecution in Aargau was permissible. The complaint was dismissed and a court fee imposed for frivolousness.
