The decision concerns an investigation procedure in which party counsel were excluded from the parties’ personal examinations. The court held that such exclusion is permissible and that cantons may, within the framework of Art. 158 ZGB and Art. 64 para. 3 BV, prefer the principle of free judicial examination over unrestricted representation. Within the limits of cantonal procedural autonomy, the cantons may accord priority to the direct examination of the parties over the presence of counsel, provided that the essential rights of defence remain safeguarded. Such safeguards are in particular consultation with counsel before and after the examination, the possibility of raising objections by separate written submission, and the right to request supplementation or repetition of the examination; these guarantees are sufficient to preserve party rights (consid. implicit).

Die persönliche Befragung der Parteien in Abwesenheit ihrer Angehörigen und der Anwälte ist in Übereinstimmung mit den Rechtsordnungen der Kantone St.Gallen und Thurgau auch in Appenzell A.Rh. ständiger Gerichtsgebrauch im Sinn von Art.1 Abs. 3 ZGB; vgl. Tuor, Das Schweiz. Zivilgesetzbuch, 1968, S. 39; Meier-Hayoz, N. 4 66 ff., namentlich 471 zu Art.1 ZGB; ferner Entscheid der Rekurskommission des Kantonsgerichtes St.Gallen vom 23. Oktober 1972, SG GVP 1972, S. 85 ff. Freie richterliche Befragung und unbeschränkte Verbeiständung einer Partei sind nicht Selbstzweck des Verfahrens. Den Kantonen steht es daher im Rahmen von Art. 158 ZGB und ganz allgemein nach Art. 64 Abs. 3 BV frei, dem einen Prinzip den Vorrang gegenüber dem anderen einzuräu­men. Mit der Möglichkeit, vor und nach der Einvernahme mit dem Klienten Rücksprache zu nehmen, auf Unzulässigkeiten in einer separaten Eingabe hinzuweisen, eine Ergänzung oder Wiederholung der Einvernahme zu beantragen, sind die Parteirechte auch für dieses Verfahren weitgehend gewahrt.
