The court held, in a neighbor-law dispute concerning drainage water, that water already naturally flowing from the upper parcel must also be accepted when drained through pipes. Under Art. 690 ZGB, the lower owner must tolerate such water, but where the inflow causes special damage, the upper owner must arrange proper conveyance to avoid that damage. If the lower owner installs the necessary drainage works himself, the upper owner must reimburse the necessary costs, reduced by the benefits obtained from the drainage.

If the lower owner carries out the necessary drainage works himself, he may claim reimbursement of the necessary costs, subject to deduction for the advantages derived from the drainage; consent to the works is irrelevant insofar as they were necessary to remedy the damage.

C. Gerichtsentscheide 3017 3017 Nachbarrecht. Durchleitungspflicht für Drainagewasser aus dem oben­liegenden Grundstück (Art. 689, 690 ZGB). Fraglich ist, ob für Drainagewasser eine Durchleitungspflicht besteht, denn dieses ist ja bereits in Röhren gefasst, so dass man sich fragen muss, ob der obere Liegenschaftsbesitzer diese Röhren einfach bis an die Grenze der untern Liegenschaft führen kann und es dem untern Liegenschaftsbe­sitzer überlassen darf, was dieser mit dem Wasser macht. Nun ergibt sich aber aus Art. 690 ZGB (Komm. Haab, S.468 N.6), dass der Unterlieger auch das durch Drainage-Röhren abgeleitete Wasser auf nehmen muss, so­fern ihm dieses Wasser schon vor der Drainage zugeflossen ist, also auch ohne dieselbe natürlicherweise zufliessen würde. Letztere Voraussetzung ist hier gegeben. Die Pflicht zur Durchleitung durch die untere Liegen­schaft besteht nach Art. 690 Abs. 2 ZGB zwar nicht allgemein, wohl aber dann, wenn der Unterlieger durch die Zuleitung des Drainagewassers ge­schädigt wird. Letzteres wird vom Kläger behauptet, indem die Zuleitung durch eine technisch ganz unzureichende Vorrichtung erfolgt sei. Wenn einem Kläger aus der Zuleitung Schaden erwächst, so ist der Beklagte ge­halten, das Wasser so durchzuleiten, dass ein besonderer Schaden vermie­den wird. Lässt der Unterlieger selbst die erforderlichen Ableitungsvorrich­tungen erstellen, so kann er vom Oberlieger verlangen, dass er ihm die Ko­sten hiefür ersetze, wobei dann allerdings auch die Vorteile zu berücksich­tigen sind, die dem Unterlieger aus der Entwässerung erwachsen, so dass der Oberlieger nicht zum Ersätze der ganzen Kosten verpflichtet ist. An sei­ner grundsätzlichen Zahlungspflicht aber kann es nichts ändern, ob die Ableitungsvorrichtung mit oder ohne sein Einverständnis erstellt wurde, insoweit sie zur Behebung der Schäden notwendig war.
