B. Entscheide der Steuerrekurskommission 2048 2048 Unterlassene Rekursbegründung. Wird ein Rekurs nicht innert Frist er­gänzt, so wird darauf nicht eingetreten. Novenrecht im Rekursverfahren.

1. Nach Art. 92 Abs. 2 StG haben Rekurse Antrag und Begründung aufzu­weisen, wobei ein ziffernmässiger Antrag verlangt ist, soweit die Höhe der Veranlagung in Frage steht (Art. 92 Abs. 1 in fine StG). Fehlen Antrag oder Begründung und werden diese Mängel auch innert Notfrist nicht beho­ben, ist auf den Rekurs nicht einzutreten. Der vorliegende Rekurs genügt den gesetzlichen Erfordernissen nicht. Wohl enthält der Rekurs wenigstens formal betrachtet den Antrag auf Rückweisung der Angelegenheit ins Veranlagungsverfahren. Dieser An­trag ist indes unbehelflich, steht doch der Rekurskommission von Gesetzes wegen umfassende Kognitionsbefugnis zu und bestehtauch kein stichhal­tiger Grund, wonach ein Entscheid in der Sache nicht möglich wäre. Im übrigen findet sich im Rekurs keine Begründung für den gestellten Antrag. Auf den Rekurs kann deshalb nicht eingetreten werden [vgl. auch StRK 26.4.1985. Nr.355],2. Auch wenn auf den Rekurs eingetreten werden könnte, müsste er auf­grund der nachfolgenden Erwägung abgewiesen werden. Im Rekursverfahren können im allgemeinen neue Behauptungen und neue Beweismittel vorgebracht werden (sog. Novenrecht). Das Novenrecht vor der Rekurskommission hat indes zur Voraussetzung, dass im Einspra­cheentscheid ein Sachurteil gefällt worden ist. Hat die Einsprachebehörde infolge verspäteter Einsprache Nichteintreten beschlossen, mithin kein . Sachurteil gefällt, so ist die Veranlagungsmitteilung in Rechtskraft erwach­sen, so dass auch die Rekurskommission eine materielle Nachprüfung nicht anzustellen hat. Wollte man anders entscheiden, so würde in der Tat - wie die Steuerverwaltung in der Vernehmlassung zutreffend aus­füh rt- die Einsprachefrist ihrer gesetzlichen Funktion beraubt. Die Rekurs­kommission kann demnach nur prüfen, ob die Steuerverwaltung zu Recht wegen Verspätung auf die Einsprache nicht eingetreten ist. Die Rekurren­tin bringt dazu zu Recht keine Rüge vor.
