E.B. asked the cantonal government to compel the municipal building commission of S. to process a garage permit application pending for about three years. The Regierungsrat held that the specific remedy invoked does not exist under cantonal administrative law, but construed the filing as a supervisory complaint. It nevertheless refused to enter into the matter because supervisory complaints against municipal commissions must be addressed first to the municipal council, which supervises such commissions under the cantonal constitution.
Art. 79 KV; supervisory complaint against a municipal commission: a filing denominated as a complaint for denial of justice and arbitrariness may, where appropriate, be treated as a supervisory complaint. Such a complaint is admissible even without express statutory regulation. However, it must be directed to the authority vested with supervisory or administrative control over the challenged body. Municipal commissions are subject to the supervision of the municipal council; accordingly, supervisory complaints against such commissions, like formal remedies against their decisions, must first be lodged with the municipal council (consid. 1).
A. Entscheide des Regierungsrates 1048 1048 Verfahren . Eine «Rechtsverweigerungs- und Willkürbeschwerde» kann unter Umständen als Aufsichtsbeschwerde entgegengenommen werden. Aufsichtsbeschwerden gegen gemeinderätliche Kommissionen sind an den Gemeinderat zu richten1. E.B. reichte beim Regierungsrat eine «Rechtsverweigerungs- und Willkürbeschwerde» gegen die Baukommission der Gemeinde S. ein mit dem Antrag, die Kommission sei zu verhalten, ein vor rund drei Jahren eingereichtes Baugesuch für eine Garage unverzüglich zu behandeln. Der Regierungsrat ist auf die Beschwerde aus folgenden Gründen nicht eingetreten: Das ausserrhodische Verwaltungsrecht kennt das Institut der Rechtsverweigerungs- und Willkürbeschwerde nicht1. Das Schreiben des E.B. kann indessen als Aufsichtsbeschwerde gegen die Amtsführung der Baukommission betrachtet werden. Eine Aufsichtsbeschwerde ist auch da zulässig, wo sie nicht in einem besonderen Verwaltungsgesetz geregelt ist (Imboden/Rhinow, Schweizerische Verwaltungsrechtsprechung, 5. Auflage, Bd. II, Nr. 14511a). Die Aufsichtsbeschwerde hat sich zu richten «an eine Instanz, der Aufsichts- oder Dienstgewalt über die Stelle, deren Amtsführung beanstandet wird, zusteht» (Imboden/Rhinow, a.a.0., Nr. 145 llb). Nach Art. 79 der Kantonsverfassung stehen die Kommissionen der Gemeinden unter der Aufsicht des Gemeinderates; gegen ihre Beschlüsse kann innert 14 Tagen1 2 an den Gemeinderat rekurriert werden. Demnach ist eine Aufsichtsbeschwerde gegen eine gemeinderätliche Kommission, gleich wie ein förmliches Rechtsmittel, zunächst an den Gemeinderatzu richten.
