The Administrative Court held that a third-country national staying illegally in Switzerland but holding a residence right in another Schengen state may generally be removed there immediately under Art. 64(2) AuG. Oktober 2013 [2C_1003/2013] nicht eingetreten.) 26 Ausschaffungshaft; Verstoss gegen Einreiseverbot; sofortige Wegweisung; Verhältnismässigkeit Hält sich ein Drittstaatsangehöriger illegal in der Schweiz auf und verfügt er in einem Schengen-Staat über ein Aufenthaltsrecht, kommt Art. 64 Abs. 2 AuG zur Anwendung. Diesfalls ist in der Regel eine sofortige Wegweisung möglich und der Betroffene ist formlos aufzufordern, sich unverzüglich in diesen Staat zu begeben. Sofern davon auszugehen ist, dass der formlosen Wegweisung Folge geleistet wird, erweist sich die angeordnete Haft als unverhältnismässig (Erw. 2.2.). (WPR.2013.161). 27 Vorbereitungshaft; Haftdauer Bei einer Vorbereitungshaft gestützt auf Art. 75 Abs. 1 lit. f AuG ist mit Blick auf Art. 37 AsylG grundsätzlich innerhalb von zehn Arbeitstagen mit einem Nichteintretensentscheid im Asylverfahren zu rechnen.
