The municipal council itself had no own interest, but the municipality of X., as the obligated residence municipality in social assistance matters, had a protected interest in the outcome and was therefore legitimized to appeal. The court also noted that remittal returns the case to the procedural stage before the annulled decision. Despite this, the court concluded that it could not enter the appeal against the procedural order.

Eine als Vorinstanz beteiligte Behörde ist nur beschwerdebefugt, wenn ihr ein eigenes Interesse zukommt oder eine besondere gesetzliche Beschwerdebefugnis besteht. Der Gemeinderat als Behörde hat regelmässig kein eigenes Interesse; die verpflichtete Wohnsitzgemeinde kann hingegen aufgrund eines schutzwürdigen eigenen Interesses beschwerdelegitimiert sein, wenn die gerügten Mängel zu einem für sie günstigeren Verfahrensausgang führen könnten (E. 2). Im Rückweisungsverfahren wird der frühere Verfahrensstand wiederhergestellt; der aufgehobene Entscheid entfaltet insoweit keine fortwirkende Verfahrenswirkung.

Zusammenfassend ist somit festzuhalten, dass das Verwaltungsgericht auf die vorliegende Beschwerde gegen den prozessleitenden Entscheid der Vorinstanz nicht eintreten darf. 54 Beschwerdelegitimation.

Die als Vorinstanz am Verfahren beteiligte Behörde kann nur dann Beschwerde führen, wenn sie ein eigenes Interesse hat oder ihr die Beschwerdebefugnis durch besondere Bestimmungen verliehen worden ist (§ 58 Abs. 4 SPG i.V.m. § 38 Abs. 2 VRPG; Michael Merker, Rechtsmittel, Klage und Normenkontrollverfahren nach dem aargauischen Gesetz über die Verwaltungsrechtspflege [Kommentar zu den §§ 38-72 VRPG], Diss. Zürich 1998, § 38 N 205). Ein eigenes Interesse des Gemeinderats als Behörde ist nicht ersichtlich und wird in der Beschwerde auch nicht geltend gemacht (vgl. AGVE 1989, S. 307 f.). Hingegen handelt der Gemeinderat für die Einwohnergemeinde X. als verpflichtete Wohnsitzgemeinde i.S.v. § 6 Abs. 1 SPG. Letztere hat am Ausgang des Beschwerdeverfahrens ein schutzwürdiges eigenes Interesse, weil die vorgetragenen Rügen zu einem für sie günstigeren Verfahrensausgang führen könnten (AGVE 1990, S. 329 mit Hinweisen). Sie ist damit zur Beschwerdeführung legitimiert (vgl. zum Ganzen: AGVE 1991, S. 363). 55 Noven im Rückweisungsverfahren.

  • Eine Rückweisung bewirkt, dass das Verfahren in den Zustand vor Erlass des aufgehobenen Entscheids zurückversetzt wird.
