The Regierungsrat of Aargau ruled on a supervisory complaint against the cantonal notarial commission. It clarified the minimum content of the authority’s response under § 38 paras. 1 and 2 VRPG: the reply must indicate whether the complaint was considered, how the authority reacted, and how it assessed the facts. It may additionally state whether supervisory measures are intended to restore proper administration, but this is optional.

87 § 38 Abs. 1 und 2 VRPG Die Beantwortung einer Aufsichtsanzeige hat Auskunft darüber zu geben, ob auf die Anzeige eingegangen wurde, wie die Aufsichtsbehörde auf die Anzeige reagiert hat, wie sie den Sachverhalt beurteilt, und fakultativ, ob und allenfalls welche aufsichtsrechtlichen Massnahmen sie zur Wiederherstellung einer ordnungsmässigen Verwaltung zu ergreifen beabsichtigt. Aus dem Entscheid des Regierungsrats vom 23. November 2016 i.S. Aufsichtsanzeige von X. gegen die Notariatskommission des Kantons Aargau (RRB Nr. 2016-001398).
