100 Ausschaffungshaft; Haftverlängerung. Unkooperatives Verhalten bei der Identitätsabklärung (wahrheitswidrige Behauptung gegenüber einem Botschafter, kein Englisch zu sprechen) kann ein besonderes Hindernis im Sinne von Art. 13b Abs. 2 ANAG und damit ein Grund für eine Haftverlängerung darstellen (Erw. II/3 und 5). Entscheid des Präsidenten des Rekursgerichts im Ausländerrecht vom 11. Juni 2003 in Sachen Migrationsamt des Kantons Aargau gegen G.O. betreffend Haftverlängerung (HA.2003.00020). 101 Ausschaffungshaft; Haftverlängerung. Behauptet ein vormals abgewiesener Asylsuchender, er sei zwischenzeitlich im Ausland gewesen und reicht dieser ein neues Asylgesuch ein, darf gestützt auf Art. 12 Abs. 1 ANAG keine formlose Wegweisung mehr ausgesprochen werden, da der Betroffene nach Art. 42 Abs. 1 AsylG während des Asylverfahrens ein Aufenthaltsrecht hat. Das Aufenthaltsrecht ist nicht davon abhängig, ob das Asylverfahren förmlich eröffnet wurde. Gelingt dem Betroffenen jedoch der Nachweis nicht, dass er zwischenzeitlich im Ausland war, ist der im Rahmen des ersten Asylverfahrens
