The case concerned whether, after a protected person changed residence and the guardianship measure had to be transferred to the newly competent authority, the new municipality had to assume the guardian’s management costs immediately or only later. The court held that municipal cost liability begins only when the newly competent authority appoints a new guardian or decides to continue the existing guardian. Until then, the costs remain governed by the prior arrangement and the primary rule that the protected person’s assets are charged first.

Entschädigung und Spesenersatz des Beistandes sind in erster Linie dem Vermögen der betroffenen Person zu belasten (Art. 404 Abs. 1 ZGB). [...] Nur für den Fall, dass das Vermögen des Verbeiständeten im Zeitpunkt der Rechnungsablage unter Berücksichtigung der Belastung der Entschädigung den Betrag von Fr. 15'000.00 unterschreitet, trägt die Gemeinde die Mandatsführungskosten des Beistandes (Art. 404 Abs. 3 ZGB i.V.m. § 67 Abs. 4 EG ZGB und § 14 Abs. 1 V KESR).
