Résumé Omnilex

The court distinguished between settlement-based termination of disposable claims in marriage-protection proceedings and mandatory judicial orders for child-related matters. It held that agreed spousal claims may be struck from the docket by a dismissal-like order, whereas child maintenance and other child issues must be decided by an authoritative judgment. It further stated that in child-support litigation, approving an agreement between the child’s representative and the father without hearing the mother violates her right to be heard.

Regeste Omnilex

Art. 176 ZGB; procedural termination in marriage-protection proceedings based on party settlement: claims subject to disposition, such as spousal maintenance, are to be removed from the docket by a dismissal order having the effect of a judgment surrogate, whereas matters subject to the official-maxim principle, in particular child maintenance and other child issues, require an authoritative judgment, even if its content corresponds to the parties’ joint request (consid. 2). Art. 279 and 287(3) ZGB; in child-support proceedings, approval of an agreement between the child representative and the father without hearing the mother violates the mother’s right to be heard (consid. 3).

Zivilkammer, vom 24. August 2009 i.S. A.S.-Z. gegen G.S.

Question juridique clé

How should a marriage-protection court dispose of claims settled by the parties, especially spousal maintenance versus child-related claims?

Solution extraite

Claims subject to party disposition should be removed from the docket by a dismissal/order equivalent to a discontinuance; child-maintenance and other child-related matters subject to official scrutiny must be decided in judgment form, even if the parties have jointly requested the same result.

Motifs extraits

Unlike divorce law, settlements in marriage-protection proceedings do not require judicial approval. Therefore, the court must distinguish between freely disposable spousal claims and non-disposable child matters.

Question juridique clé

Does approving a child-support agreement concluded between the child representative and the father without hearing the mother violate the mother’s right to be heard?

Solution extraite

Yes. The court commits a denial of the right to be heard against the mother if it confines itself to approving such an agreement without giving her an opportunity to be heard.

Motifs extraits

A decision on minor-child maintenance under Arts. 279 and 287(3) ZGB requires procedural participation of the mother; approval of the agreement alone is insufficient where her hearing rights are concerned.
