The Administrative Court held that a person receiving social assistance who lives in a stable cohabitation cannot, in the relevant respects, be treated as a married couple for the calculation of material assistance. It also held that a monthly rent difference of CHF 195 may, depending on the circumstances, justify a requirement to move to cheaper housing. Possible moving or furniture-storage costs do not defeat that requirement because social assistance covers only necessary and appropriate expenses.

234 Verwaltungsgericht 2006 satz der Rechtsgleichheit (Art. 8 BV) verlangt in der Rechtsanwendung auch, dass in den relevanten Punkten tatsächlich ungleiche Sachverhalte auch unterschiedlich behandelt werden (BGE 129 I 113 Erw. 5.1). Eine Mietzinsdifferenz von Fr. 195.-- pro Monat kann daher je nach den Umständen im Einzelfall übermässige Wohnkosten begründen. Die Rüge der Beschwerdeführerin, eine solche Mietzinsdifferenz rechtfertige die Auflage zum Bezug einer günstigeren Wohnung schon im Grundsatz nicht, ist daher nicht zutreffend. Auch ein Vergleich mit allfälligen Umzugskosten oder Kosten für die Einlagerung von Möbeln vermag daran nicht zu ändern. Bei diesen Kosten sind im Rahmen der Sozialhilfe nur die notwendigen, den Bedürfnissen angemessenen Auslagen zu ersetzen (vgl. SKOS-Richtlinien, Kapitel C.8). 45 Materielle Hilfe.
