A municipality had granted a resident the use of a boat mooring under a document labeled as a lease. After a municipal regulation reallocated competence for managing the boat moorings, the legal question arose whether the arrangement was a unilateral administrative order or a public-law contract. The Regierungsrat held that the distinction is relevant mainly for the remedy path and that public-law applicability alone does not determine the qualification; decisive are statutory room for contractual action and the parties’ mutual will to be bound.

128 Abgrenzung der Verfügung vom Vertrag.

  • Obwohl die materiellen Rechtswirkungen von Verfügung und (öffentlichrechtlichem) Vertrag für die am Rechtsverhältnis Beteiligten zumindest im Ergebnis fast gleich sind und die Unterscheidung insofern ohne grosse praktische Bedeutung ist, ist die Abgrenzung relevant bezüglich des Rechtsschutzweges.
  • Aus der Anwendbarkeit des öffentlichen Rechts allein lässt sich noch nicht schliessen, dass ein Rechtsverhältnis autoritativ durch Verfügung und nicht rechtsgeschäftlich durch Vertrag erfolgt. Für die rechtliche Qualifikation ist insbesondere ausschlaggebend, ob einerseits die gesetzliche Ordnung überhaupt Raum lässt für vertragliches Handeln des Gemeinwesens, ob andererseits ein gegenseitiger Bindungswille der am Rechtsverhältnis beteiligten Parteien auszumachen ist. Entscheid des Regierungsrates vom 23. März 2005 i.S. Gemeinderat X. gegen Departement des Innern Aus dem Sachverhalt: 1. Die Gemeinde X. verfügt über eine Konzession zur Erstellung und zum Betrieb einer Bootssteggemeinschaftsanlage auf der staatlichen Gewässerparzelle des Hallwilersees. Aufgrund eines als "Mietvertrag" benannten Dokumentes räumte sie Herrn A. 1996 das Recht zur entgeltlichen Benützung des Bootsplatzes Nr. 95 an diesem Bootssteg ein. Am 19. Februar 2001 erliess der Gemeinderat ein neues "Reglement für die Verwaltung und Benützung des gemeindeeigenen Bootssteges"; darin wurde die Bootsstegkommission u.a. als für die Verwaltung, die Aufsicht sowie für die Zuteilung der Bootsplätze und den Abschluss der Mietverträge als zuständig bezeichnet.
