The Administrative Court of Aargau dealt with an appeal concerning a cost guarantee for material assistance. It held that the request for a cost guarantee may also be filed by the institution or person benefiting from it. However, the institution itself is not entitled to appeal against a refusal of the cost guarantee, because the substantive entitlement belongs in principle to the person seeking assistance and that person's circumstances are decisive. The decision thus rejected the institution's procedural standing on appeal.
Standing; cost guarantee for social assistance-related expenses: the request for a cost guarantee may also be lodged by the institution or person for whose benefit it is sought; however, appeal legitimacy against the refusal of such a guarantee is reserved to the materially entitled person. Since the substantive claim to assistance belongs in principle to the person in need and his or her personal circumstances are determinative, the assisting institution lacks its own legal interest to challenge the refusal (consid. 3–4).

Beizupflichten ist auch der vom Gesundheitsdepartement vertretenen Ansicht, dass es, weil es sich um eine vom Zivilund Zivilprozessrecht geregelte Materie handelt, jedenfalls vorzuziehen ist, mit Korrespondenz und nicht mittels formellen Verfügungen vorzugehen. Im vorliegenden Fall wurden an das Nichthandeln bzw. die fehlende Kooperation der Verwandten keine Rechtsnachteile geknüpft oder auch nur angedroht, sodass der Beschwerdeführer durch Disp. Ziff. 5 nicht wirklich beschwert wurde. Unter dieser Voraussetzung erscheint der Fehler in der gewählten Form (indem verfügt wurde) allein zu wenig gewichtig, um eine Aufhebung der streitigen Ziffer zu rechtfertigen. 67 Beschwerde, aufschiebende Wirkung.
