Art. 31 Abs. 1 WG; administrative seizure of weapons and transfer to third parties: the federal regime establishes a uniform nationwide basis for seizure and custody measures. Where the return of weapons to the entitled person is excluded, the competent authority must ensure that the weapons are removed from the control and influence sphere of the affected persons. A transfer of ownership to close third parties is incompatible with that purpose and must be refused (consid. 2-3).

Waffenrecht 159 Beschlagnahme von Waffen; Eigentumsübertragung an Dritte. -Zuständigkeit, Verfahren und Grundsätze für behördliche Anordnungen bei ausgeschlossener Rückgabe an die eigentumsberechtigte Person (Erw. 2). -Beschlagnahmte Waffen sind dem Herrschafts- und Einflussbereich der durch die Beschlagnahme betroffenen Personen zu entziehen; eine Übertragung ins Eigentum von nahe stehenden Personen ist deshalb abzulehnen (Erw. 3). Mit dem gestützt auf Art. 40 bis der Bundesverfassung der Schweizerischen Eidgenossenschaft vom 29. Mai 1874 (aBV) erlassenen Bundesgesetz über Waffen, Waffenzubehör und Munition (Waffengesetz, WG) vom 20. Juni 1997 und der bundesrätlichen Verordnung über Waffen, Waffenzubehör und Munition (Waffenverordnung, WV) vom 21. September 1998 haben auch die verwaltungsrechtliche Beschlagnahme sowie die Frage der Aufbewahrung von Waffen, wesentlichen Waffenbestandteilen, Waffenzubehör, Munition und Munitionsbestandteilen (nachfolgend zusammengefasst: Waffen) eine gesamtschweizerische allgemeine Regelung erfahren. Art. 31 Abs. 1 WG sieht vor, dass die zuständige Behörde Waffen aus dem Besitz von jenen Personen beschlagnahmt, die diese entweder ohne Berechtigung tragen (lit. a) oder bei denen ein Hinderungsgrund nach Art. 8 Abs. 2 WG vorliegt (lit. b).
