Gegen eine trotzdem erfolgte Sistierung ist deshalb nicht die Beschwerde nach § 272 Abs. 3 ZPO offen, sondern kann einzig Aufsichtsbeschwerde wegen Rechtsverzögerung oder Rechtsverweigerung nach § 80 GOG i.V.m. § 32 Abs. Die sachliche Zuständigkeit bei Klagen auf Abänderung von Scheidungsurteilen liegt in jedem Fall beim Bezirksgericht (§ 12 Abs. 2 ZPO). Sachverhalt Der mit einer Abänderungsklage befasste Präsident des Bezirksgerichts X fragte die Parteien nach Durchführung eines zweiten Schriftenwechsels an, ob sie die Beurteilung ihres Falles durch das Gerichtspräsidium oder das Gesamtgericht wünschten. Beide Parteien erklärten sich mit der Beurteilung durch den Gerichtspräsidenten einverstanden. Aus den Erwägungen 1. a) Über die Appellation gegen einen Entscheid eines Gerichtspräsidenten entscheidet das Obergericht auf Grund der Akten, wenn nicht zu einer Beweisverhandlung geladen wird (§ 331 ZPO). Vorliegend hat der Gerichtspräsident gestützt auf § 11 lit. d ZPO über das Abänderungsbegehren des Klägers entschieden. b) Der Richter prüft die prozessuale Zulässigkeit einer Klage, insbesondere die sachliche Zuständigkeit, von Amtes wegen. Fehlt eine Prozessvoraussetzung, ergeht ein Nichteintretensentscheid im Sinne von § 273 ZPO.
