132 Kostengutsprache für die Erstellung eines Haushaltgutachtens.

  • Ob das Opfer weitere Hilfe i.S. von Art. 3 Abs. 4 OHG oder Entschädigung i.S. von Art. 12 OHG beansprucht, bestimmt sich nach dem gestellten Begehren und der dazugehörigen Begründung (Erw. 2 c/aa).
  • Die Opferhilfe muss unmittelbar dem anspruchsberechtigten Opfer zukommen und nicht etwa einer Drittperson (Erw. 2 c/bb).
  • Kosten für die Erstellung eines Haushaltsgutachtens können als weitere Hilfe i.S. von Art. 3 Abs. 4 OHG geltend gemacht werden (Erw. 2 c/cc und dd). Entscheid des Regierungsrates vom 29. August 2001 in Sachen M.M. gegen Verfügung des Kantonalen Sozialdienstes. Aus den Erwägungen 2. a) Der Beschwerdeführer beantragt, ihm sei im Rahmen der weiteren Hilfe gemäss Art. 3 Abs. 4 OHG Kostengutsprache für die Erstellung eines Haushaltgutachtens zu erteilen. Der Beschwerdeführer wird seit dem tragischen Vorfall im Behindertenheim rund um die Uhr von seiner Mutter betreut. Mit dem Haushaltsgutachten sollen der zeitmässige Umfang und die daraus resultierenden Kosten abgeklärt werden. Dabei ist gemäss den Eingaben des Rechtsvertreters des Beschwerdeführers davon auszugehen, dass die bisherige Heimbetreuung kostenmässig günstiger war als die Einzelbetreuung durch die Mutter. Diese Mehrkosten sollen bei der Haftpflichtversicherung des Schädigers eingefordert werden (Betreuungsschaden). Zu denken sei hier an eine Rente bis zum Tod des Beschwerdeführers bzw. bis er allenfalls wieder in ein Heim
