The President of the Aargau Appeals Court in Foreigners' Law reviewed the detention conditions in the case of E.C. at the request of the Aargau migration authority. The court held that cell confinement in administrative detention should generally be limited to night hours, that a work-ready detainee must be offered suitable work within 14 days or be transferred/released, that house rules must be provided in a comprehensible language or explained with an interpreter, and that telephone restrictions fall exclusively within the migration authority’s competence under § 28 EGAR. The decision was later confirmed by the Federal Supreme Court.

If an inmate willing to work cannot be offered suitable employment within 14 days, the authority must transfer the person to a facility offering work opportunities or release them; however, there is no entitlement to uninterrupted work. The house rules of the removal center must be communicated in a language understood by the detainee, if necessary with an interpreter. Restrictions on telephone use are reserved to the migration authority and cannot be imposed by detention officers, even in cases of misconduct (consid. II/4.5.2, 4.5.4, 4.5.6, 4.5.9).
400 Rekursgericht im Ausländerrecht 2008 Im Rahmen der Administrativhaft sind Zelleneinschliessungen grundsätzlich auf die Zeit der Nachtruhe zu beschränken (E. II./4.5.2.). Kann einer arbeitswilligen Person innert 14 Tagen keine geeignete Beschäftigung angeboten werden, ist sie in eine Anstalt mit Beschäftigungsmöglichkeiten zu verlegen oder zu entlassen. Die Beschränkung des Telefonverkehrs ist gemäss § 28 EGAR dem Migrationsamt vorbehalten und kann auch bei Fehlverhalten der Häftlinge nicht durch Vollzugsbeauftragte ausgesprochen werden (E. As a rule, cell confinement in administrative detention must be limited to the night-rest period.
The detention regime must remain proportionate; day-long confinement is generally impermissible unless justified by operational necessities and suitable alternatives are ensured.
