The Constitutional Court upheld the constitutional complaint, held that the complainant's right to equality before the law had been violated by the challenged judgment, and annulled that judgment. I.Der Beschwerdeführer ist durch das angefochtene Erkenntnis im verfassungsgesetzlich gewährleisteten Recht auf Gleichheit aller Staatsbürger vor dem Gesetz verletzt worden.
Das Erkenntnis wird aufgehoben.
II.Der Bund (Bundesminister für Inneres) ist schuldig, dem Beschwerdeführer zuhanden seines Rechtsvertreters die mit € 2.856,– bestimmten Prozesskosten binnen 14 Tagen bei sonstiger Exekution zu ersetzen.
