The Constitutional Court upheld a constitutional complaint against an administrative decision. It found that the complainant had been violated in the constitutionally guaranteed right to equal treatment of foreigners among themselves. The challenged decision was annulled in the scope of operative point A.I. In addition, the Federation, through the Federal Minister of the Interior, was ordered to reimburse procedural costs of EUR 3,144 within 14 days.
Art I Abs 1 Bundesverfassungsgesetz BGBl Nr 390/1973; equal treatment of foreigners among themselves: if a challenged decision infringes this guarantee, the Constitutional Court annuls it in the affected scope. Cost reimbursement follows in favor of the successful complainant, including enforceable procedural costs, where awarded in the operative part.
I.Der Beschwerdeführer ist durch das angefochtene Erkenntnis im verfassungsgesetzlich gewährleisteten Recht auf Gleichbehandlung von Fremden untereinander (ArtI Abs1 Bundesverfassungsgesetz BGBl Nr 390/1973) verletzt worden.
Das Erkenntnis wird im Umfang des Spruchpunktes A.I. aufgehoben.
II.Der Bund (Bundesminister für Inneres) ist schuldig, dem Beschwerdeführer zuhanden seiner Rechtsvertreterin die mit € 3.144,– bestimmten Prozesskosten binnen 14 Tagen bei sonstiger Exekution zu ersetzen.
