Chapter 64:30:01 Definitions

ARSD 64:30:01:01 Definitions

Terms defined in SDCL 32-3-1 have the same meaning when used in this article. In addition, terms used in this article have the following meaning:

(1) "VIN," vehicle identification number;

(2) "Original VIN," the number assigned to a vehicle by the manufacturer, consisting of numerals or letters or both and used primarily for registration and identification purposes;

(3) "Replacement VIN," the vehicle's original VIN reproduced on a replacement identification number plate and attached to the vehicle;

(4) "Assigned VIN," a number preassigned, imprinted, or embossed on a plate, and then attached to a vehicle that has no identifiable VIN or whose VIN has been destroyed or removed;

(5) "Public VIN," a vehicle identification number located in a conspicuous location on a vehicle for easy access to law enforcement personnel and other interested parties;

(6) "Secondary VIN," a vehicle identification number or a number derived from a vehicle identification number located in an area kept confidential for law enforcement use;

(7) "VIN plate," unless otherwise stated in this article, the replacement identification number plate or assigned identification number plate;

(8) "Front door pillar post," a post located forward of the front door and running between the door and windshield;

(9) "Front door latch post," the post located at the trailing edge of the front door to which the door latches;

(10) "State code," the two-character alphabetic code used by the U. S. postal service for abbreviations of states' names;

(11) "Component," a vehicle part marked by the vehicle manufacturer with a unique identifiable number traceable to the vehicle through the manufacturer;

(12) "Gross visual examination," an examination of a motor vehicle to determine if it is the vehicle described in the certificate of title last issued for that vehicle, consisting of either an examination of the entire motor vehicle or an examination of the vehicle identification numbers, or both.

ARSD 64:30:02:02 Vehicles to be assigned numbers

Vehicle identification numbers may be assigned to rebuilt, salvage, and specially constructed vehicles, all vehicles and identifiable components with missing or altered identification numbers, and those vehicles where discrepancies are noted between the VIN recorded on the title or other ownership documents and the public VIN on the vehicle. The assigned number shall not exceed 21 characters and shall incorporate the state code. The state code shall precede and shall be an integral part of the assigned number.

ARSD 64:30:02:03 Interstate transfers and retitling

The installation of a replacement or assigned VIN plate on a vehicle in compliance with another state's numbering system shall be considered to be in compliance with this state's system when the vehicle is brought into the state for subsequent retitling and registration.

ARSD 64:30:02:04 Application for VIN assignment

Any person attempting to obtain an assigned or replacement vehicle identification number, except a person primarily doing business as a manufacturer of new vehicles, shall apply to the county treasurer. Upon completion of the application form, the department shall initiate the registration process and schedule an appointment for the inspection and identification of the vehicle.

ARSD 64:30:02:04.01 VIN requirements for trailers

Any person manufacturing trailers shall obtain and attach a 17-digit vehicle identification number on each trailer produced. For each manufactured trailer and any other trailer which weighs less than 3,000 pounds and has no trailer identification number, the county treasurer may assign an identification number from the trailer identification numbers assigned to the county by the department. The applicant must stamp the number into the trailer frame and then obtain verification from a law enforcement officer that the correct number has been imprinted onto the trailer.

For any trailer which weighs 3,000 pounds or more, application for an identification number shall be made to the county treasurer. The trailer must be inspected by the department which shall attach the trailer identification number plate after the successful completion of the inspection.

ARSD 64:30:02:06 Definition of year on cars, pickups, trucks, and vans

The year on a car, pickup, truck, or van shall be the year of the public vehicle identification number located on the dash or door post of the vehicle attached by the manufacturer. If the public vehicle identification number plate has been removed, secondary identification numbers must be used to identify the year of the vehicle. Prior to the removal of a public vehicle identification number written authorization from the department must be obtained.

Chapter 64:30:03 Inspection and assignment of number

ARSD 64:30:03:01 VIN inspection

If the original identification number can be established, the inspecting official shall provide and attach a replacement VIN plate repeating the original identification number. If no original identification number exists or can be determined, an assigned VIN plate shall be provided by the inspecting official. If the public VIN for a vehicle cannot be determined, the secondary VIN shall be searched for subject to the following conditions:

(1) A secondary VIN search may not be conducted in a location which is open to public view or in the presence of any unauthorized person;

(2) Secondary VIN locations shall be obtained from the National Insurance Crime Bureau (NICB);

(3) If the secondary vehicle identification number has been recorded but does not readily identify the vehicle, the applicant shall be advised further checking is required and the applicant shall return with the vehicle to complete the process at a date to be determined by the department;

(4) The inspecting official shall submit the secondary VIN to the NICB and may request factory information. On receipt of the requested information, the inspecting official shall contact the applicant for completion of the identification procedure and VIN assignment; and

(5) Written information concerning the location of secondary VINs may be maintained only by the NICB.

ARSD 64:30:03:02 VIN removed or altered

If the inspecting official is unable to positively identify a vehicle and has reason to believe that the original identifying number has been intentionally removed or altered or has reason to question the ownership documents submitted, he shall deny the application for assigned or replacement VIN and may take enforcement action.

ARSD 64:30:03:03 Vehicle with no VIN

A vehicle with valid ownership documents but no identification numbers which can be restored shall be provided an assigned VIN.

ARSD 64:30:03:04 Component identification

Identifiable components may be assigned a VIN only when a manufacturer's number has been removed, altered, or defaced and the request results from a court directive, an enforcement document, or when the component has been impounded by a law enforcement agency.

ARSD 64:30:03:05 Replacement identification numbers

A replacement identification number shall be assigned to a vehicle having a dash removed that has a serial number attached and in which a new replacement dash is being installed. If a used dash is being installed, a new serial number shall be assigned and a rebuilt title issued to the owner.

ARSD 64:30:03:06 Motorcycles built with after market parts

A motorcycle that is constructed with all new after market parts that have manufacturer's statements of origins shall be titled by the seventeen-digit frame identification number. If it does not have a seventeen-digit number, a new serial number shall be assigned and a rebuilt title issued to the owner.

Chapter 64:30:04 VIN plates

ARSD 64:30:04:01 Plate design and storage

The VIN plate shall be made of anodized aluminum foil. The VIN plate shall have an adhesive backing with self-destruct capability. Each VIN plate shall carry a control number for accountability purposes.

Replacement and assigned VIN plates shall be requisitioned from the department. VIN plates shall be stored in a secure location and access restricted to authorized employees. Complete records of control numbers and issued VIN plates shall be maintained by the department.

ARSD 64:30:04:02 Duplicate replacement or assigned plate

If an assigned or replacement VIN plate was issued and it becomes damaged or mutilated, the owner shall submit a notarized statement of facts describing how the VIN plate became damaged or mutilated to the county treasurer. A duplicate VIN plate bearing the same numbers as previously assigned may be issued as follows:

(1) If the mutilated VIN plate is still affixed to the vehicle, the applicant must make the vehicle available to the inspecting official and the applicant shall remove the VIN plate in the inspecting official's presence and the inspecting official shall affix the replacement VIN plate on the vehicle; or

(2) If the VIN plate is already detached, the applicant shall surrender it to the inspecting official, who shall affix the replacement VIN plate on the vehicle.

Any replacement or assigned VIN plate which is damaged prior to or during application or a replacement VIN plate on which a numbering error occurs shall be returned to the department by the inspecting official. Each replacement or assigned VIN plate being returned shall be rendered unusable prior to mailing by cutting the VIN plate in half diagonally without destroying the legibility of the control number.

ARSD 64:30:04:03 Lost assigned plate

If a vehicle has been issued an assigned VIN plate and the VIN plate is lost, a substitute VIN plate bearing that number shall be issued if the number can be verified. If the number cannot be verified for a vehicle, the department shall assign a new VIN number and the inspecting official shall affix the new VIN plate to the vehicle. The request for replacement of a lost VIN plate shall be treated as a new application.

ARSD 64:30:04:04 Removal of damaged manufacturer's plate

Original manufacturer's VIN plates which are damaged or mutilated shall be removed by the vehicle owner or his designated agent in the presence of the inspecting official prior to the affixing of a replacement VIN plate.

ARSD 64:30:05:02 Motorcycle -- Number affixed to frame

The inspecting official shall affix a replacement or assigned VIN plate to the clean surface area on the frame of the motorcycle. The plate may not be applied to the headstock.

ARSD 64:30:05:06 Trailers

For a homemade or rebuilt trailer weighing less than 3,000 pounds without a VIN, the owner shall apply to the county treasurer for a number which is supplied to the treasurer by the department. The owner shall attach the number to the trailer by stamping the number either to the left side of the tongue portion or the frame, if the tongue is permanently attached, or to the left frame rail at the front of the trailer, if the tongue is not permanently attached. The trailer is subject to inspection by a law enforcement agency after the number is attached. The applicant shall also sign an affidavit which states that the applicant built or rebuilt the trailer.

For a manufactured trailer weighing 3,000 or more pounds without a VIN, the owner shall apply to the department for a VIN number. If the trailer had a VIN which was lost or damaged, the same number may be reassigned if the number is ascertainable. The number, which is issued on a VIN plate, shall be attached in the same location as on a homemade or rebuilt trailer. The applicant shall sign an affidavit which states that it is a manufactured trailer and gives the reason for the absence of a VIN.

ARSD 64:30:05:07 Newly constructed vehicles

The department shall provide a newly constructed vehicle which does not have a specially assigned or readily identifiable number with an assigned VIN to be used as the public number.

ARSD 64:30:05:08 Motor vehicles -- Number affixed to front door

On any vehicle, including a rebuilt vehicle, other than a motorcycle or trailer, the inspecting official shall affix the VIN plate to a clean, visible surface on the left front door pillar post. If possible, the number shall be placed adjacent to the number which was assigned by the manufacturer or another state to the part used to rebuild the vehicle. If this is not possible due to construction of the vehicle, alternative visible locations are as follows:

(1) The left front door latch post;

(2) The left side of the dashboard;

(3) The left side of the steering column support; or

(4) The frame on the left side of the vehicle in the engine compartment.

ARSD 64:30:05:09 Component parts

On component parts requiring replacement or assigned numbers, the VIN plate shall be affixed to a clear surface area as close as practicable to where an original number would be located.

ARSD 64:30:05:11 Rebuilt motorcycle 1970 or newer

A 1970 or newer model motorcycle shall be titled by the frame number as specified by the manufacturer. The South Dakota title shall reflect the frame number as the serial number of the motorcycle.

If the motorcycle has an after market frame replacement, a new serial number shall be assigned and a rebuilt title issued to the owner. If the engine is replaced by an after market engine or cases, a new serial number shall be assigned and a rebuilt title issued to the owner.

If the motorcycle has had an original manufactured replacement engine installed, a new serial number is not assigned, but the motorcycle shall be inspected. The title is not issued as a rebuilt.

ARSD 64:30:05:12 Rebuilt motorcycle 1969 or older

A 1969 or older model motorcycle shall be titled by the engine number as specified by the manufacturer. The South Dakota title shall reflect the engine number as the serial number of the motorcycle.

If the motorcycle has an after market engine replacement or cases, a new serial number shall be assigned and a rebuilt title issued to the owner. If the frame is replaced by an after market frame, a new serial number shall be assigned and a rebuilt title issued to the owner.

If the motorcycle has had a frame replacement with a 1969 or older frame, a new serial number is not assigned, but the motorcycle shall be inspected. The title may not be issued as a rebuilt. If the motorcycle has a frame replacement with a 1970 or newer frame, a new serial number shall be assigned and a rebuilt title issued to the owner.
