205 CMR 8.00 Disposition rules and regulation for greyhound racing

8.01 Definitions

8.01: Definitions Disposition shall mean, euthanasia, transfer to another jurisdiction, adoption or donation or sale for medical research or other purpose. Humane Manner shall mean, by means of euthanasia by lethal injection, or by such other standard of humane killing as may be established by the American Veterinary Medical Association.

8.02 General

8.02: General No person licensed by the State Racing Commission shall put to death, within the Commonwealth, a racing greyhound, except in a humane manner.

8.03 Duties of Trainers

8.03: Duties of Trainers (1) Any trainer/kennel operator responsible for the disposition of a greyhound who has schooled, qualified or raced at a Massachusetts track shall fill out a statement of Disposition before such disposition may take place. The form is available in the Racing C ommission Office and must be witnessed by a M.S.R.C. (Massachusetts State Racing Commission) Inspector and filed with the Greyhound Racing Secretary. (2) No owner, trainer or kennel operator shall cause or permit any racing or retired greyhound to be put to death until reasonable efforts by such owner, trainer, or kenneloperator to place such greyhound for adoption with a responsible person or entity have been exhausted. No racing or retired greyhound shall be put to death except in a humane manner.

8.04 Duties of Greyhound Racing Secretary

8.04: Duties of Greyhound Racing Secretary (1) The Greyhound Racing Secretary shall insure that each trainer/kennel operator has filed a disposition form on every greyhound that has schooled, qualified or raced at his/her track when the greyhound is subject to the rules of disposition. The responsibility of filing this form with the Greyhound Racing Secretary shall be the duty of each licensed trainer/kennel operator. (2) The Greyhound Racing Secretary shall not release the certificate of registration to the trainer/kennel operator until the Disposition form is filed, signed and properly witnessed.

8.05 Stakes Race

8.05: Stakes Race The Racing Secretary shall compile a list from the trainer/kennel operator of all greyhounds that have left the C ommonwealth to go to another jurisdiction to participate in a bona fide stakes race/races. The list shall contain the names of all greyhounds that participate in the stakes race, the jurisdiction the stakes race is held, the name of the stakes race/races, and the present state of the greyhound (whether the greyhound has stayed in the fo reign jurisdiction, returned to the Commonwealth, or has been disposed of in any of the manners expressed in 205 CMR 8.00).

8.06 Duties of M.S.R.C. Personnel

8.06: Duties of M.S.R.C. Personnel The M.S . R. C . Ve terinarian shall monitor the Disposition program at regular intervals with the assistance of the inspectors under the direction of the Director of Racing. The commission shall maintain accurate records and statistics regarding the disposition of all greyhounds that have participated in dog racing, including schooling races, in the commonwealth. Such records shall include the following information: (1) the greyho und ' s registered name and left and right ear tattoos, the name and address of the greyhound's owner, trainer, and kennel operator at the time of disposition, and the name and address of the race track where the greyhound last raced prior to disposition; (2) if the greyhound has been transferred to another race track, the name and address of the race track that received the greyhound and the name, business address, telephone number and driver's license number and state of the person who received the greyhound on behalf of the receiving race track; (3) if the greyhound has been retired for breeding, the name and address of the facility that received the greyhound and the name, business address, telephone number and driver's license number and state of the person who received the greyhound on behalf of the receiving facility; (4) if the greyhound has been adopted or placed for adoption, the name, address and telephone number of the person or entity that received the greyhound and, if applicable, the name, business address, te le p hone number and driver's license number and state of the person who received the greyhound on behalf of the adoption facility; (5) if the greyhound has been euthanized, the name, address, professional title and professional affiliation of the person performing the euthanasia, the manner of euthanasia, and a detailed statement of reasons why the greyhound was euthanized rather than adopted or placed for adoption; (6) if the greyhound has been sold or donated to an individual, corporation or entity, the name and address of the individual, corporation or entity purchasing or receiving the greyhound, the purpose for which the greyhound is being purchased or received, and the name, business address, telephone number and driver's license number and state of the person who received the greyhound on behalf of the receiving individual, corporation or entity; (7) if the greyhound's disposition does not fit into any of the categories in 205 CMR 8.06(1) through (6), the owner, trainer or kennel operator must state, in detail, the greyhound's destination, the name, business address, telephone number and driver's license number and state of the person who received the greyhound, and the specific purpose for which the greyhound has been received, sold, transferred or donated.

8.07 Duties of Kennel Operators

8.07: Duties of Kennel Operators Each kennel must keep a register of all greyhounds kept at the kennel including the name and/or tattoo of each dog. When a greyhound is disposed of from that kennel, as defined in 205 CMR

8.08 Penalties for Violations

8.08: Penalties for Violations All disposition forms shall be completed and signed under the pains and penalties of perjury by the greyhound's owner, trainer or kennel operator, whose signature shall be witnessed by a designated representative of the state racing commission. Whoever knowingly makes a false written statement on a disposition form shall be punished by imprisonment for up to two years and a fine of up to $2,500, or both such fine and imprisonment. A person found guilty of knowingly violating 205 CMR 8.08 for a second or subsequent offense shall be punished by imprisonment for not less than one, nor more than five years, or a fine of not less than $5,000, or both such fine and imprisonment.

8.09 Maintenance of Records and Reports to Commission

8.09: Maintenance of Records and Reports to Commission All disposition records will be maintained by the Commission for a period of seven years. A statistical report will be included in the Commission’s annual report. REGULATO RY AUTHO RITY 205 CMR 8.00: M.G.L. c. 128C.
