20 CAR § 434-101 Arkansas State Hospital Parking Committee {#sec-20-car-434-101 omnilex-key=us-ar-regs-official--title-20-part-434--20 CAR § 434-101}

20 CAR § 434-101. Arkansas State Hospital Parking Committee.

(a) The Arkansas State Hospital Parking Committee will consist of the following individuals:

(1) Both assistant hospital administrators;

(2) The Division of Aging, Adult, and Behavioral Health Services of the Department of Human Services representative;

(3) The Director of Maintenance or designee;

(4) The public safety officers Chief or designee;

(5) The Project Manager for Construction; and

(6) The Director of Nursing or designee.

(b) The Chair of the Arkansas State Hospital Parking Committee will rotate between the two (2) Arkansas State Hospital assistant administrators with each being the chair for six (6) months:

(1) January through June; and

(2) July through December.

(c)(1) The committee will meet monthly and may be called for other meetings as needed.

(2) The Arkansas State Hospital Administrator will have the authority to call the committee into session to rule on appeals or for other issues that might develop.

20 CAR § 434-102 Registration of vehicles {#sec-20-car-434-102 omnilex-key=us-ar-regs-official--title-20-part-434--20 CAR § 434-102}

20 CAR § 434-102. Registration of vehicles.

(a) Registration shall be accomplished December 15-31 of each year for the upcoming year at locations and times specified.

(b)(1) Vehicles are defined as any self-propelled vehicle having two (2) or more wheels.

(2) All vehicles on the Arkansas State Hospital campus are required to register and display a current parking hangtag.

(3)(A) Parameters for the operation and parking of motor vehicles may be viewed on the campus map.

(B) Campus maps will be available in the following locations:

(i) Administration building switchboard;

(ii) Admissions office; and

(iii) The public safety checkpoint.

(c)(1)(A) Hangtags are valid from January 1 one (1) year through December 31 each year.

(B) Hangtags must be displayed by hanging on the rear view mirror so the number can be read through the front windshield from the outside.

(C) These hangtags can be moved from vehicle to vehicle.

(D) Do not tape hangtag on vehicle or lay on dash or seat.

(2)(A) Motorcycle operators will be issued a permit that is a sticker, which cannot be moved to a vehicle.

(B) Motorcycle operators who also have vehicles will need to register these separately.

(d) Lost/stolen hangtags. Employees will be charged one dollar ($1.00) to replace lost or stolen tags.

(e)(1) Hangtags are the responsibility of the purchaser and must be removed prior to sale or transfer of the vehicle or upon termination of employment.

(2) Motorcycle operators must remove these stickers by scraping them off.

(f)(1) Falsifying registration information, such as buying hangtags for another person, is not allowed, and these individuals will be fined fifty dollars ($50.00) and may be subject to discipline under DHS Policy 1084, Employee Discipline Policy: Conduct/Performance.

(2) Also, any employee who allows another individual to purchase a hangtag for him or her will be fined fifty dollars ($50.00) and may also be subject to discipline under the policy.

(g)(1) Temporary hangtags/placards are available at the Public Safety Department of the Arkansas State Hospital for staff members who have misplaced their hangtag.

(2) These hangtags/placards are provided at no cost and are valid for a maximum of seven (7) days unless otherwise indicated on the placard/hangtag.

(3) The hangtag will be displayed on the rear view mirror and the placard will be displayed on the dashboard.

(4)(A) These may also be used for individuals assigned here for no more than seven (7) days or for individuals attending meetings.

(B) The convener of the meeting will provide public safety with the list of individuals attending the meeting or will obtain the temporary hangtags to distribute to attendees of the meeting and may provide public safety with the list of license plates of attendees.

(h) Parking lot assignments.

(1) Anyone issued a parking hangtag will park in the lot to which they are assigned when issued their hangtag.

(2) The color of the hangtag designates in which lot a person is allowed to park.

20 CAR § 434-103 Restricted parking areas {#sec-20-car-434-103 omnilex-key=us-ar-regs-official--title-20-part-434--20 CAR § 434-103}

20 CAR § 434-103. Restricted parking areas.

(a) Yellow curbs. Restricted parking at all times.

(b) Red. Reserved for fire/emergency vehicles.

(c) Blue/white. Designated disability parking zones.

(d) Signs. Restricted as posted.

20 CAR § 434-104 Towing and impounding of vehicles {#sec-20-car-434-104 omnilex-key=us-ar-regs-official--title-20-part-434--20 CAR § 434-104}

20 CAR § 434-104. Towing and impounding of vehicles.

(a) The Arkansas State Hospital reserves the right to immobilize, tow, and/or impound any vehicle that is:

(1) Parked on hospital property in such a way as to constitute a serious hazard; or

(2) Owned by a person who is not a Division of Aging, Adult, and Behavioral Health Services of the Department of Human Services/hospital employee or student having three (3) or more violations in any calendar year.

(b) The Public Safety Department of the Arkansas State Hospital may direct any wrecker service to carry out any towing action.

(c)(1) Violators will be responsible for paying all costs for removal, impounding, and storage of such vehicles.

(2) Vehicles will be held until all charges are paid.

20 CAR § 434-105 Payment of violations/fines {#sec-20-car-434-105 omnilex-key=us-ar-regs-official--title-20-part-434--20 CAR § 434-105}

20 CAR § 434-105. Payment of violations/fines.

(a)(1) A person receiving notice of a parking or traffic violation should go to the public safety checkpoint or the public safety booth to pay the fine.

(2) If the checkpoint is closed, the person must contact the public safety booth at 501-686-9212 for assistance in paying this fine.

(b)(1) Fines for all citations, with the exception of the booting of a vehicle, may be paid at once or may be mailed to the Arkansas State Hospital Fiscal Director at 4313 West Markham, Little Rock, AR 72205.

(2) Fines are due within seven (7) calendar days of the issuance of the citation.

(c) If a vehicle is booted, the fine must be paid before the boot is removed.

(d)(1) Department of Human Services, Division of Aging, Adult, and Behavioral Health Services of the Department of Human Services, and hospital employees, hospital students, and residents will receive tickets.

(2) All others parking in restricted areas will have a boot placed on their cars and must pay a sixty dollar ($60.00) fine prior to removal of the boot.

(e) If the fine is for division staff or hospital employees who have three (3) or more unpaid fines in a calendar year, this issue will be referred to their supervisor for possible disciplinary action under DHHS 1084.

(f) Signs will be posted in parking lots with instructions on how and where to pay fines.

20 CAR § 434-106 Moving violations {#sec-20-car-434-106 omnilex-key=us-ar-regs-official--title-20-part-434--20 CAR § 434-106}

20 CAR § 434-106. Moving violations.

(a) Moving violations include all traffic laws as stated in the Arkansas motor vehicle and traffic laws and State Highway Commission rules.

(b) The official Arkansas State Hospital parking citation notice placed on vehicles will be sufficient as a summons for violation of this part.

20 CAR § 434-107 Accidents {#sec-20-car-434-107 omnilex-key=us-ar-regs-official--title-20-part-434--20 CAR § 434-107}

20 CAR § 434-107. Accidents.

(a) All traffic accidents occurring on the grounds controlled by the Arkansas State Hospital must be reported immediately to the Public Safety Department of the Arkansas State Hospital by calling 501-686-9212.

(b) If you are unable to contact the number, you may call the main hospital number of 501-686-9000.

20 CAR § 434-108 Accessible parking {#sec-20-car-434-108 omnilex-key=us-ar-regs-official--title-20-part-434--20 CAR § 434-108}

20 CAR § 434-108. Accessible parking.

(a)(1) As required, a number of parking slots have been set aside for use by individuals with disabilities.

(2) Each spot has been clearly marked with signs and blue and white paint on the space.

(b)(1) Vehicles found illegally parked in these slots are subject to impoundment and a fine in addition to towing and impoundment fees.

(2) Only individuals who have been issued, and are displaying, a disability license plate or placard issued by the State of Arkansas are permitted to park in spaces marked with blue and white stripes.

(c)(1) Arkansas State Hospital employees/students parking in accessible slots must also have a valid hospital hangtag.

(2) When applying for a parking permit and an employee/student has either the placard for persons with disabilities or license plate, the employee/student must produce the form indicating the employee/student is assigned this plate or placard.

20 CAR § 434-109 Special event parking {#sec-20-car-434-109 omnilex-key=us-ar-regs-official--title-20-part-434--20 CAR § 434-109}

20 CAR § 434-109. Special event parking.

(a)(1) Contact the Public Safety Department of the Arkansas State Hospital for any special event parking requests.

(2) These will be reviewed by the Arkansas State Hospital Administrator or the Arkansas State Hospital Parking Committee.

(b) The Arkansas State Hospital reserves the right to:

(1) Set aside areas as necessary for special events in all parking areas; and

(2) Temporarily block certain streets as necessary without notice to the public.

20 CAR § 434-110 Visitor parking {#sec-20-car-434-110 omnilex-key=us-ar-regs-official--title-20-part-434--20 CAR § 434-110}

20 CAR § 434-110. Visitor parking.

(a) Visitors may park only in areas designated for visitors.

(b) Visitors who park in violation may be issued a citation.

(c) Visitors who come for meetings or other official business may be given temporary parking hangtags/placards in advance by the convener of the meeting.

20 CAR § 434-111 Appeals {#sec-20-car-434-111 omnilex-key=us-ar-regs-official--title-20-part-434--20 CAR § 434-111}

20 CAR § 434-111. Appeals.

(a)(1) All appeals must be made within fourteen (14) days of the date of the citation or towing and impoundment of the vehicle.

(2) Appeals made after fourteen (14) days will not be considered.

(b) Appeal forms can be obtained at the:

(1) Public safety officers (PSO) booth;

(2) PSO checkpoint;

(3) The Arkansas State Hospital switchboard/information area; and

(4) The hospital Admissions’ Office.

(c)(1) Fines and penalties must be paid immediately.

(2) If the appeal is successful, the fine/penalties will be refunded.

(3) If fines remain unpaid for more than six (6) months and are in excess of one hundred dollars ($100), the Arkansas State Hospital Administrator may order PSO to contact the Overpayment Unit of the Office of Administrative Services of the Department of Human Services for collection.

(d)(1) Once completed, the appeal form is to be hand-delivered or mailed to the administrator.

(2) These can be mailed to the administrator via interoffice mail or regular mail at 4313 West Markham Street, Little Rock, AR 72205 or faxed to the administrator at 501-686-9483.

(3) They can also be taken to the administrator’s office.

(e)(1) The administrator will have the authority to convene the Arkansas State Hospital Parking Committee to rule on the appeal.

(2) The person making the appeal will be notified in writing of the outcome of appeal.

(3) The person may request via the appeal form to appear before the committee in person.

20 CAR § 434-112 Arkansas State Hospital Public Safety Department {#sec-20-car-434-112 omnilex-key=us-ar-regs-official--title-20-part-434--20 CAR § 434-112}

The Public Safety Department of the Arkansas State Hospital is open twenty-four (24) hours per day, seven (7) days per week. For all public safety services call 501-686-9212.

20 CAR § 434-113 Parking violation charges {#sec-20-car-434-113 omnilex-key=us-ar-regs-official--title-20-part-434--20 CAR § 434-113}

20 CAR § 434-113. Parking violation charges.

(a)(1) The responsibilities for payment of fines incurred for traffic violations will rest with the registrant.

(2) In the event vehicle registration has not been completed, responsibility lies with the owner and/or operator of the vehicle.

(b) Persons violating the rules as stated while using a motor vehicle on campus will be fined under the Arkansas State Hospital system of traffic violations listed below.

20 CAR § 434-114. Parking rules.

(a)(1) All parking rules will be enforced seven (7) days a week, twenty-four (24) hours a day.

(2) All personnel, including visitors, are expected to adhere to all campus and state rules regarding safety procedures.

(3) Arkansas State Hospital cannot and does not assume the obligation of providing parking spaces for all vehicles at all times.

(b) The responsibility for finding a legal parking space rests with the vehicle operator.

(c) Lack of space is not a valid excuse for violating a parking rule.

(d)(1) Standard parking/traffic rules and definitions, as enacted in the Arkansas motor vehicle and traffic laws and State Highway Commission rules will be rigidly enforced on the hospital campus at all times, twenty-four (24) hours per day, seven (7) days per week.

(2) Unless otherwise noted, the speed limit is twenty miles per hour (20 m.p.h.) on the hospital campus.

(e)(1) Violators of established parking and traffic rules may be issued a hospital citation.

(2) Violation notices will be affixed to the motor vehicle or presented to the driver.

(f) Office checkpoint or public safety vehicles are considered parked when left stopped or unattended for any period of time.

(g) The hospital assumes no responsibility for the care and/or protection of any vehicle or its contents at any time while it is operated or parked on the campus.

(h) Pedestrians are considered to always have the right-of-way.

(i)(1) Staff and students assigned to various hospital departments are expected to be familiar with and abide by the rules at all times.

(2) The fact that any vehicle does not receive a violation notice while the vehicle is parked or operated in violation of any rules or law does not mean or imply that such a rule or law is invalid.

(j)(1) It will be the responsibility of any driver of a disabled vehicle, i.e., dead battery, out of gas, keys locked inside, etc., to notify the Public Safety Department of the Arkansas State Hospital of the problem and the location of the disabled vehicle if the vehicle will be on the lot past the end of the driver’s shift.

(2) If the driver/owner of this vehicle has called a tow truck or repair service, please notify the Public Safety Department.

(3) Failure to make notification may result in the vehicle’s being either towed or ticketed.

(k)(1) Vehicles are assumed abandoned if left parked and stationary for a period of two (2) weeks.

(2) Such vehicles will be towed at the owner's expense.

(l) Buses and other large vehicles, as well as special purpose vehicles, are required to park in areas designated by the Public Safety Department.

(m) Employees/students are responsible for all violations by a vehicle displaying a hangtag issued in their name.

(n)(1) Operating a motor vehicle in any manner which may create a disturbance on campus may be considered a traffic violation.

(2) This includes:

(A) Excessive use of boom box, stereo, or horn;

(B) Illegal exhaust systems;

(C) Squealing of tires; or

(D) Placing pedestrians or other drivers in a hazardous situation.

(o)(1) Only one (1) type of hospital hangtag is to be displayed on a vehicle at a time.

(2) Note. This is for some employees who work shifts and may have separate parking areas depending on their shift assignment.

(p) Obey regulatory signs and barricades established by the Public Safety Department.

(q) Loading zones are to be utilized for loading/unloading only.

(r)(1) Vehicles will be parked within designated parking boundaries and in no case shall they overlap into or onto:

(A) Roadway;

(B) Crosswalk; or

(C) Sidewalk.

(2) The fact that other vehicles are parked improperly shall not constitute an excuse for parking with any part of the vehicle over the line.

(s)(1) The time limit on zones will be observed at all times.

(2) Vehicles are considered parked when left unattended for any period of time.

(t)(1) A traffic ticket or any other communication from a hospital public safety officer, while in the performance of their duties, is considered to be an official hospital notice.

(2) For hospital employees, failure to respond will make the recipient subject to disciplinary action.

(u)(1) If a hangtag is not visible to the officer while he or she is issuing a citation, the citation will be for no current hangtag.

(2) If, in the course of issuing a citation, the officer discovers the hangtag, the officer has the discretion to downgrade that ticket to improper display only.

(v) The hospital reserves the right to restrict or revoke the use of an automobile on campus to anyone if the:

(1) Use of that vehicle is thought to be detrimental; or

(2) Person has abused the privilege of operating said vehicle on or off campus.

Each individual parking hangtag is color coded and staff, students, and others will only park in the parking area that is designated for that color of hangtag.

Motorbikes, motor scooters, motorcycles, and bicycles must be operated only on streets normally designated for automobile use.
