This matter is before the Court on appellant’s unopposed motion to dismiss appeal.
The parties have settled the underlying litigation, and appellant seeks to dismiss the
appeal.

The Court, having considered the unopposed motion, is of the opinion that the
motion should be granted. See TEX . R. A PP . P. 42.1(a)(1). Therefore, the unopposed
motion to dismiss is granted, and the appeal is hereby dismissed. In accordance with the
unopposed motion and apparent agreement of the parties, costs are taxed against the
party incurring same. Having dismissed the appeal at the parties’ request, no motion for
rehearing will be entertained.
