Appeal From Richland County

Unpublished Opinion No. 2007-UP-250

Submitted May 1, 2007 – Filed May 22, 2007

APPEAL DISMISSED

Assistant Appellate Defender Robert M. Dudek, of Columbia, for Appellant.

Attorney General Henry Dargan McMaster, Chief Deputy Attorney General John W. McIntosh, Assistant Deputy Attorney General Donald J. Zelenka, of Columbia; Warren B. Giese, of Columbia, for Respondent.

PER CURIAM:  Appellant, Sharon L. Smith, was indicted for and convicted of the murder of Charles Gibson.  The trial judge sentenced Smith to forty-eight years imprisonment.  Smith’s counsel attached to the brief a petition to be relieved as counsel, stating that he had reviewed the record and concluded this appeal lacks merit.  Smith filed a separate pro se brief.  After a thorough review of the record pursuant to Anders v. California, 386 U.S. 738 (1967) and State v. Williams, 305 S.C. 116, 406 S.E.2d 357 (1991), we dismiss[1] the appeal and grant counsel’s petition to be relieved.

APPEAL DISMISSED.

ANDERSON, HUFF, and BEATTY, JJ., concur.

[1] We decide this case without oral argument pursuant to Rule 215, SCACR.
