Reconsideration, dated June 18, and the Commissioner’s Order of Dismissal,
dated April 8, vacated; case remanded to the Court of Appeals for the following
purposes: (1) consideration of petitioner’s response to the state’s motion to
dismiss, filed in the Court of Appeals on March 25, and (2) determination
whether petitioner’s petition for judicial review of the final order of the Oregon
State Board of Nursing, revoking her license, was timely filed on March 2,
2020.

allowed in part, limited to the appropriate disposition of Counts 1, 3, 4, 5,
6, 9, and 11, in light of Ramos v. Louisiana, 590 US __, 140 S Ct 1390, 206
L Ed 2d 583 (2020); petition for review otherwise denied. The court accepts
the state’s concession that defendant’s convictions on Counts 1, 3, 4, 5, 6, 9,
and 11 in Josephine County case no. 16CR06640 must be reversed. The court
therefore reverses defendant’s convictions on Counts 1, 3, 4, 5, 6, 9, and 11 in
case no. 16CR06640. Decision of Court of Appeals reversed in part, judgment
of circuit court reversed in part, and case remanded to the circuit court for
further proceedings.
