By order of October 29, 2025, we granted leave to appeal the May 14, 2025
judgment of the Court of Appeals, and this case was placed on the April 2026 session
calendar for argument and submission. On April 5, 2026, the parties filed a joint motion
to dismiss the appeal. On order of the Court, we grant that motion, VACATE our October
29, 2025 order granting leave to appeal and the April 6, 2026 Chief Justice order to the
extent that it directs the Clerk of the Court to reschedule the case for argument at the May
2026 session, and DISMISS the application for leave to appeal without costs.
