PEOPLE OF THE STATE OF MICHIGAN,
Plaintiff-Appellee,
v
DARRELL LEE RIDER, JR.,
Defendant-Appellant.
By order of March 6, 2026, plaintiff was directed to answer the application for leave
to appeal the January 6, 2026 order of the Court of Appeals. On order of the Court, the
answer having been received, the application for leave to appeal is again considered. We
direct the Clerk to schedule oral argument on the application. MCR 7.305(I)(1). The
parties shall file supplemental briefs in accordance with MCR 7.312(E), addressing:
(1) whether the holding in People v Peterson, 450 Mich 349, 369 (1995), that “syndrome
evidence” offered to explain certain victim behavior is not subject to reliability testing
remains good law in light of Daubert v Merrell Dow Pharm, Inc, 509 US 579 (1993),
Kumho Tire Co, Ltd v Carmichael, 526 US 137, 141 (1999), Gilbert v DaimlerChrysler
Corp, 470 Mich 749 (2004), and MRE 702; (2) if it remains good law, whether the Peterson
Court erred when it held that syndrome evidence is not subject to reliability testing; and
(3) if Peterson was wrongly decided, whether it should nonetheless be retained under
principles of stare decisis, see Coldwater v Consumers Energy Co, 500 Mich 158, 172-174
(2017).
The Prosecuting Attorneys Association of Michigan and Criminal Defense
Attorneys of Michigan are invited to file briefs amicus curiae. Other persons or groups
interested in the determination of the issues presented in this case who are not exempt from
the motion requirement under MCR 7.312(H) may move the Court for permission to file
briefs amicus curiae.
