By order of July 19, 2024, the application for leave to appeal the July 5, 2023 order
of the Court of Appeals was held in abeyance pending the decision in People v Kardasz
(Docket No. 165008). On order of the Court, the case having been decided on December
19, 2025, ___ Mich ___ (2025), the application is again considered. Pursuant to MCR
7.305(I)(1), in lieu of granting leave to appeal, we REMAND this case to the Court of
Appeals for consideration as on leave granted.
