Court of Appeals, State of Michigan
ORDER
LAURA MAE SHARP V RODRIGUEZ MEKELL DUNBAR
Docket No. 379791
LC No. 2022-065850-DP
Michael F. Gadola, Chief Judge, acting under MCR 7.203(F)(1), orders:
The claim of appeal is DISMISSED for lack of jurisdiction because the January 21, 2026
order appealed from is not a final order appealable by right. MCR 7.203(A)(1); MCR 7.202(6)(a).
Specifically, the postjudgment order denying defendant’s motion to vacate child support order does not
meet the definition of final under MCR 7.202(6)(a)(i) or MCR 7.202(6)(a)(iii). Further, to the extent that
defendant is attempting to claim an appeal from the February 18, 2026 order denying reconsideration,
“[a]n order denying reconsideration is not a final order from which one may appeal of right.” Nye v Gable,
Nelson & Murphy, 169 Mich App 411, 415; 425 NW2d 797 (1988). Dismissal is without prejudice to the
filing of a late appeal under MCR 7.205(A)(4), provided such a filing meets all requirements under the
court rules and is not time-barred.
