The motion to waive fees is GRANTED for this case only.
Pursuant to MCR 7.205(E)(2), in lieu of granting the delayed application for leave to appeal,
we VACATE that portion of the trial court’s March 6, 2025 opinion and order rejecting defendant’s
sentencing issue brought pursuant to People v Parks, 510 Mich 225; 987 NW2d 161 (2022), and remand for
reconsideration of that issue only. While the trial court’s analysis of this issue was correct at the time the
trial court decided the motion, the Supreme Court has since extended Parks to 19- and 20-year-old offenders.
It has also held that this decision applies “retroactively to all relevant criminal cases on collateral review.”
People v Taylor, ___ Mich ___; ___ NW3d ___ (April 10, 2025) (Docket Nos. 166428 and 166654); slip
op at 37-38. On remand, the trial court shall reconsider this sentencing issue only in light of Taylor. In all
other respects, the delayed application for leave to appeal is DENIED because defendant failed to
demonstrate that the trial court erred by denying the successive motion for relief from judgment.
This order is to have immediate effect. MCR 7.215(F)(2). We do not retain jurisdiction.
