This case was held in abeyance pending our Supreme Court’s decision in People v Robert
J. Kardasz, ___ Mich ___ (2025) [Docket No. 165008], which was decided on December 19, 2025. This
case is now set for oral argument on March 11, 2026.
On the Court’s own motion, each party shall file with the Clerk of this Court and serve
upon the other party a supplemental brief within 14 days after the certification of this order, which
addresses what impact, if any, Kardasz has on the resolution of the issues pending in this appeal. The
supplemental briefs shall be limited to 20 pages.
