Rick, J., I dissent. In lieu of granting the application for leave to appeal, I would VACATE both the
January 22, 2026 order and the February 18, 2026 order, and REMAND the matter to the Washtenaw
Circuit Court for additional proceedings. On remand, I would direct the trial court to reconsider plaintiffs’
motion to strike defendants’ supplemental preliminary and expert witness list and defendants’ motion for
leave to amend witness list in light of Smith v Beaumont Health, ___ Mich ___; ___ NW3d ___ (2026)
(Docket No. 167716).
