Court of Appeals, State of Michigan
ORDER
SKF V ED JR
Docket No. 381201
LC No. 25-003590-PH
Stephen L. Borrello, Chief Judge Pro Tem, acting under MCR 7.203(F)(1), orders:
The claim of appeal is DISMISSED for lack of jurisdiction because the June 5, 2026 order
is not appealable by right. MCR 3.709(B)(1). While a ruling on a “respondent’s first motion to rescind
or modify” an ex parte personal protection order (PPO) is appealable by right, MCR 3.709(B)(1)(b)
(emphasis added), the June 5, 2026 order did not decide respondent’s first motion to modify or terminate
the ex parte PPO, which was entered on April 18, 2025. Rather, the June 5, 2026 order decided a
subsequent motion to modify or terminate the ex parte PPO after it was extended for a second time.
Therefore, the June 5, 2026 order may only be appealed by leave to appeal. MCR 3.709(B)(2). Dismissal
is without prejudice to respondent-appellant filing an application for leave to appeal, MCR 7.205, provided
such a filing meets all requirements under the court rules and is not time-barred.
