Plaintiff-Appellee’s Motion for Immediate Consideration is GRANTED. Plaintiff-
Appellee’s Emergency Motion to Clarify Stay is GRANTED.
Courts speak through written orders and judgments. In re Contempt of Henry, 282 Mich
App 656, 678; 765 NW2d 44 (2009). The Trial Court’s June 30, 2026 Order listed three (3) discrete
Orders on several motions which were considered as part of an eight-day evidentiary hearing, of which,
Defendant-Appellant only sought leave to appeal one – “that [he] is found in civil contempt of court and
shall serve 90 days in jail.” After this Court denied leave to appeal, Defendant-Appellant then sought
leave in the Michigan Supreme Court for the same sole reason. On July 30, 2026, in lieu of granting leave
to appeal, the Supreme Court stayed “[e]nforcement of the trial court’s June 30, 2026 contempt order”
and gave this Court the discretion to modify, set aside, or place conditions on the stay “if it appears that
the appeal is not being vigorously prosecuted or if other appropriate grounds appear.” The Supreme
Court’s July 30, 2026 order, by its plain terms and as informed by Defendant-Appellant’s argument and
issue presented, does not mention or reference the non-appealed orders issued on June 30, 2026 by the
trial court. Therefore, we hold that only the order that Defendant-Appellant is found in civil contempt of
court and is to serve 90 days in jail is stayed, and the remaining Orders in the June 30, 2026 Order remain
in effect.
