On the Court’s own motion pursuant to MCR 7.216(A)(7), this matter is REMANDED to
the trial court for the appointment of counsel to represent defendant-appellee in this appeal. Defendant’s
prior trial counsel, attorney James Earl King, has advised this Court that he is unable to represent defendant
on appeal. The trial court shall appoint counsel for defendant within 21 days of the entry of this order,
and the appointed attorney shall promptly file a copy of the order of appointment in this Court.
This Court retains jurisdiction.
